Interpleader petition

State Farm Mutual Automobile Insurance Company, through its counsel, David C. Ray, Esq., Blue Bell, Pa., has filed a petition for interpleader, asking the court to discharge it from any an all liability under a motor vehicle insurance policy by virtue of its agreement to pay the $100,000 policy limit listed in the contract.

The defendants are Richard Weaver, 665 Columbia Ave., Palmerton, Richard Weaver, his son, of Oxford, N.C., and Suzann Weaver, his daughter, of Panama, Okla.

State Farm contends it issued a policy to Richard Weaver that covered the automobile he was operating on May 6, 2009, when it went out of control and crashed in Markham, Fauquier County, Va., resulting in the death of his wife, Maryanne Weaver.

The petitioner contends it is willing to pay the maximum amount of the available policy of insurance to which the decedent would be entitled to such persons as shown to be lawfully entitled to receive it, and lists the spouse and the couple's two adult children as the only persons who may have an interest in the matter.
