Sales contract
Ford Motor Credit Co., Box 6508, Mesa, Ariz., filed a complaint against Carolyn and Thomas Hudock, 536 Towamensing Trails, Albrightsville, alleging they defaulted on a motor vehicle installment sales contract. Sought is $4,184.90.
Multiple actions
Peter J. Turko, individually, and derivatively on behalf of Palmerton Construction Co., 202 Delaware Ave., Apt. C, Palmerton, filed actions against Palmerton Construction Company Inc., The Service Team, both of 6565 Interchange Rd., Lehighton, and James H. Everett Jr., 1735 Strohls Valley Rd., Lehighton.
A second action filed by the same plaintiff against Blue Ridge Insulators Inc., 6565 Interchange Rd., The Service Team and Everett. A third action with Northeast Exteriors Inc., 3295 Forest Inn Rd., Palmerton, with Turko's address also listed, as plaintiff was filed against The Service Team and Everett.
In the suits it is stated that Turko has a 50 percent shareholder interest in Plamerton Construction and Blue Ridge Insulators.
The allegations in all three actions are bascially the game.
The suit alleges that on Jan. 1, 1994, Palmerton Construction entered into a contract with The Service Team. Also, the suits alllege a similar agreement was entered with Blue Ridge Insulators and Everett as a official of the companies.
The suit alleges The Service Team and Everett engaged in improper competition with Palmerton Construction and began to take business away from Palmerton Construction, creating a separate entity, Blue Valley Construction. It further alleges Palmerton Construction employees were used for work with the new firm and Everett has continued on a "destructive and debilitating unilateral management course" concerning Palmerton Construction.
The suits also alleged Everett continues to receive preferential and unlawful payments to The Service Team without regard for Palmerton Construction. There are other like allegations in the suit.
The six count actions allege, among other things, breach of contract, unjust enrichment, and intentional interference with contractual relations. Damages in excess of $50,000 is sought on each count against the defendants.
