Nesquehoning man gets state time for burglary, DUI
A Nesquehoning man was given a state prison term, and a break, on Thursday in Carbon County court after pleading guilty to one count each of burglary and driving under the influence (DUI). He was one of several defendants in pending cases to enter a guilty plea.
Neighbors' home
Salvatore J. Canzoneri, 21, was charged by Nesquehoning police with entering the home of Joseph and Martha Ciavella on May 31. Chief Sean Smith was dispatched to the home for a report of a break-in in progress. Upon arrival the victim identified Canzoneri as entering his home and taking his wife's purse. Smith observed Canzoneri leaving the home and found $15, the amount taken from the purse, on him.
The victims are neighbors of Canzoneri, it was noted.
Canzoneri was arrested for the DUI charge on May 12 along Bankway in Lehighton. Given a test, the results showed the presence of controlled substances.
Defense Att. Paul Levy told Nanovic that Canzoneri had a heroin problem that had taken over his life. He went into rehab about a year ago but it did not help.
Levy also said Canzoneri was on a probation program in Chester County at the time and has been revoked and resentenced on Sept. 17 to serve one to two years in a state prison.
On the burglary charge Nanovic imposed a state prison term of one to two years. On the DUI count a prison term of 72 hours to six months, a fine of $1,000, one year license suspension and zero tolerance on drug or alcohol use. The prison terms will be followed by two years probation.
Canzoneri was given a break in the sentencing when Nanovic ordered the two terms run concurrent to each other and concurrent with the Chester County sentence. He was given credit for 110 days on the burlgary charge and 72 days on the DUI count.
He was also ordered to get a drug and alcohol evaluation and follow any recommendation for treatment, supply a DNA sample and pay the $250 fee and make total restitution to the victim and insurance company of $1,244.50.
Other pleas
Ryan T. Heiser, 27, of Lehighton, pleaded to one count of false reports.
He was arrested on March 18 by Lehighton police at his residence when he made a report that his mother's television was stolen. Further investigation revealed the TV was not stolen. Heiser said he gave it to a person he owed money too to pay off the debt.
Nanovic placed him on probation for a year and ordered he get a D&A evaluation and render three hours of community service for the time he on probation.
David John Angeleri, 43, of South Brodheadsville, pleaded to one count of DUI. He was arrested on July 30, 2008, along SR534 in Penn Forest Township. A state trooper observed Angeleri's car crossed the center line and strike a garbage truck then continue on. The trooper attempted to pull Angeleri over but he did not stop until he got to his residence.
Nanovic sentenced him to serve 90 days to five years in jail, a fine of $1,500 and costs and one year license suspension. He must also get a D&A evaluation. On a summary offense he was fined $25 and costs.
He began the jail term immediately.
