Tamaqua woman withdraws appeal for summary violation

A Tamaqua woman withdrew her appeal from a citation for public drunkenness and entered a guilty plea to the charge when she appeared before Judge Jacqueline Russell in Schuylkill County court recently. She was one of nine who received hearings on summary convictions by district justices for various offenses.

Monique M. Nunemacher, 48, of 242 N. Columbia St., was cited on Aug. 10, on N. Columbia Street in Tamaqua. She was ordered to pay a fine of $25 plus court costs.

Karen Fenstermacher, 45, of Berwick, withdrew her appeal from a charge of driving while her license was suspended-DUI related and pleaded guilty to the suspension charge and requested be placed in the Immediate Punishment Program (IPP). Her sentence was deferred to a later date in order to determine if she qualifies for the program, which is a probation under house arrest. If she does not qaulify she was granted work release from a prison sentence. She was cited by Patrolman Jeffrey S. Wainwright, Tamaqua police, last Aug. 26 when stopped in the borough on SR209.

Robin Grigalonis, 42, of 2 Flag Lane Road, Pottsville, failed to appear for her hearing on her appeal from three motor vehicle violations charges and the judge dismissed her appeal and the sentence imposed by the district justice stands.

On a charge of driving an unregistered car Russell adjudged her guilty and imposed a fine of $200 plus $66.50 costs; on a charge of failing to carry car insurance was fined $300 plus $20 costs; and on the charge of failing to have registration and cerrficate of title on her car was fined $75 plus $20 costs.

Stephen R. Barrett, of 30 S. Third St., Frackville, on a charge of disorderly conduct was adudged guilty and was fined $100 and $l35 costs. He was involved in an argument with his girlfriend at 4 a.m. on Aug. 21 when he came home from work and claimed she was intoxicated thrashed the house. A charge of harassment was dismissed by the court.

Patrick Labuz, Drums, entered a guilty plea to a charge of disorderly conduct after the Commonwealth agreed to nol pros the charge of participating in an underage drinking party in Cove Village, North Union Township. He was fined $100 plus $l35 costs.

Kenneth Fisher, owner of a property on Washington Street, Port Carbon, withdrew his appeal from violating a borough ordinance by failing to properly maintain his property when the Commonwealth agreed to reduce the fine from $300 to $100 plus $65.50 costs. He was charged by Code Enforcement Officer Margaret McBreen with allowing the grass to grow higher than six inches as is the limit under the borough ordinance. He also agreed to maintain the ground in the future.

Rebecca Ann McElhenny, 28, of 4 Chunky Lane, Shenandoah, entered a gulty plea when the Commonwealth reduced the charge against her. She was originally charged by Trooper Joseph J. Aponick with permitting an unlicensed driver to operate her vehicle. This was changed to a guilty plea of allowing her car be driven which was not propertly equipped. The fine was reduced from $200 to $25 plus $96.50 cost.

William A. Davidock, of 635 Winter Ave., West Hazleton, withdrew his appeal after being allowed to enter a gulty plea to a lesser charge. He originally charged by Trooper Barrett with operating his motorcycle on Interstate 81 at 125 miles per hour. He pleaded guilty to driving 95 miles an hour in a 65 mile zone and his fined was reduced from $300 to $92.50 plus $73.50 in costs. He also pleaded guilty to three summary charges, careless driving, switching from one lane to another and failing to drive at a safe speed and was fined $25 each plus $60 costs.

Sandra L. Miller, 608 W. Market St., Pottsville, had her sentence on a charge of driving while her license was suspended deferred to a later date to give the probation department time to evaluate if she qualifies for work release. She had withdrawn her appeal and pleaded guilty.
