Tamaqua man among nine to have probation/parole revoked

A Tamaqua man was among nine people who had their probations and/or paroles revoked recently by Schuylkill County judges as follows:

Gary Keach, of 228 W. Cottage Ave., had his probation revoked by Judge D. Michael Stine for violating three conditions: failed to report a new arrest, failed to refrain from assaultive behavior and failed to perform required number of hours of community service.

He was re-sentenced to serve four to 23 months in the county prison and received credit for serving 118 days. He had pleaded guilty in November 2008 to theft and criminal conspiracy charges filed by Cpl. Henry Woods, Tamaqua police.

Rasheem Hassan Whatley, 24, Philadelphia, had his parole revoked by Stine for violating three conditions: failing to report a new arrest, failed to remain within 50 miles of his approved residence and failed to abstain from unlawful possession of narcotics. His 186 days of liberty were revoked, however, he was given credit for serving 77 days in prison and was granted re-parole on the charge of criminal trespass. On a charge of giving false identification he was re-sentenced to serve nine months probation consecutive to the first sentence.

Michael Dennis McClain, 29, Minersville, had his probation revoked by Judge Cyrus Palmer Dolbin on two counts of retail theft was re-sentenced to serve 12 months less one day in the county prison and 47 months less one day on probation. He removed electronic video games from the Boutigue Store, Schuylkill Mall, and entered guilty pleas in April 2006.

Jessica Lynn Pretti, 23, Pottsville, had her probation revoked by Dolbin and 144 days of libery taken away and added to her maximum date of release which was extended to April 15, 2010, but she was ruled eligible for re-parole.

Pretti was re-sentenced on two counts of simple assault and one count of defiant trespass to serve 36 months on probation and will be subject to certain special conditions, shall not possess or consume alcoholic beverages, received a drug and alcohol assessment and complete any recommended counseling and shall receive a mental health evaluation. Pretti had pleaded guilty to the charges on Feb. 2, 2008, which arose from her arrest at Friendly's Restaurant, Fairlane Village Mall, Pottsville.

Joseph L. Dunckley, 30, Schuylkill Haven, had his probation revoked by Judge John E. Domalakes and his 89 days of liberty were taken away and he was remanded to the county prison to serve his original sentence and his maximum date of release was pushed back to Nov. 5, 2010. He had pleaded guilty in November 2006 to charges of indecent assault. He had his probation revoked on two prior occasions, May 2007 and September 2008.

Braxton John Moore, 26, Pottsville, had his probation revoked by Dolbin and he was re-sentenced on a charge of retail theft from A-Plus Mini Mart to serve 12 to 24 months in a state correctional institution and on a charge of public drunkenness was fined $100 and costs.

Jonathan James Kintzel, 27, Pottsville, had his parole revoked by Dolbin and his 268 days of liberty taken away and added to his maximum sentence which was extended to Sept. 24, 2010. He had pleaded guilty last June to possession of drug parapahernalia and was placed on probation 12 months. He now must serve out the sentence in prison.

Brandon Benjamin Leslie, 21, Slatingtown, had his probation revoked by Domalakes and he was re-sentenced on charges of possession of a small amount of marijuana and drug paraphernalla to serve five to 12 months in the county prison. He had pleaded guilty to the charges last November. He also shall undergo drug and alcohol and mental health evaluations.

Justin Michael Gernert, 26, Schuylkill Haven, was removed from the Accelerated Rehabilative Disposition (ARD) probation program by President Judge William E. Baldwin. He now faces trial on charges of possession of a small amount of marijuana and drug paraphernalia as charged by Patrolman Gregory S. Meisner, Schuylkill Haven.
