Win appeals
Four people were found not guilty by Judge D. Michael Stine of various charges. All had been found guilty by district justices and they took appeals to court from the decisions.
Michael McGinley, 44, Water St., Mahanoy Plane, Gilberton, was found not guilty oif driving without a valid license; Charles Zambinsi, Minersville, not guilty of disorderly conduct; Consualo Quijano, Shenandoah, parent charged with violation of school attendance by her child, and William J. Lemaire, Shenandoah, speeding and driving while his license was suspended.
The appeal of Diane M. Reichwein, Shamokin, was dismissed because it was filed to late. She was charged with operating a vehicle without financial responsibility.
Revoke parole
William Bernice Gray Jr., 45, Frackville, admitted to vioilating his parole and it was revoked by Judge John E. Domalakes and he was recommitted to the county prison with a loss of 411 days at liberty which will be added to his current maximum date which was extended to Sept. 19, 2011. Gray had pleaded guilty in September 2008 to criminal conspiracy to rob the KNBT bank in the Schuylkill Mall and after serving a jail sentence of 66 days had been placed on probation for 23 months.
Recommitted
Jeffrey Charles Weir, of New Ringgold, admitted violating his probation and was remanded by Judge Jacqueline Russell to serve the balance of a 60 days to 24 months less one day sentence in the county prison. He received credit for serving 59 days. He also must undergo evaluation for drug and alcohol and mental health and must make restitution of $1,394.54 to Todd Lonergean, of Port Clinton, and $2,000 to Klover Contracting Company, for theft of tools. Weir had pleaded guilty to burglary.
Revoke IPP program
Tobi Allen Metz, 30, Schuylkill Haven, admitted violating conditions of the Intermediate Punishment Program (IPP) and it was revoked by Judge Domalakes and he was re-sentenced to serve four months to five years in the county prison with credit for time-served of 92 days. His new maximum sentence was extended to Jan. 12, 2015. Metz had pleaded guilty to driving under the influence (DUI) of alcohol in May 2008 and was placed in the IPP to serve six months after serving 30 days in the county prison.
Register of Wills
Register of Wills and Clerk of the Orphans' Court Michael M. McCord released the activities of his office for the month of March.
There were 86 estates processed, 48 marriage licenses issued, and one adoption completed.
Inheritance tax remitted to the state was $522,878.51 and county fees collected totaled $20,722.50.
Back on trial list
Five people who were placed in the Accelerated Rehabilitated Disposition (ARD) probation program because it was their first offense lost their chance to clear their name as they were removed from the program by President Judge Willliam E. Baldwin for violating terms of their probation. Their cases now go back on the criminal trial list for scheduling to be heard by a jury and if convicted they will have a criminal record. Removed from the program were:
Tessie Ann Haring, 32, Pottsville, Hunter Glen Motley, 19, Pottsville, and Jeremy Tyler Culbert, 19, Saint Clair, all face driving under the influence (DUI) charges; James Edward Marconis Jr., 21, Pottsville, faces possession of drug paraphernalia; and Billy Jack Price, 37, Ringtown, faces charges of resisting arrest, public drunkenness and two counts of disordelry conduct.
