Revocations

Marlin Hosier, 49, of 8 W. High St., Coaldale, had his probation revoked by Judge Cyrus Palmer Dolbin but because he had served 29 days in prison was released on probation again. Hosier had pleaded guilty in May 2008 to drug charges which were brought by Patrolman Raymond Tonkinson, Tamaqua police.

Christopher M. Reed, 22, Mahanoy City, had his probation revoked by Dolbin and he was re-sentenced to serve three to 12 months in the county prison. He received credit for 112 days served and is eligible to apply for parole. Reed pleaded guilty last Feb. 19 to possession of drugs and was placed on probation.

Timothy Donald Keefer, 43, Pottsville, had his probation revoked by Judge D. Michael Stine for violating rules fixed by the court and he was re-sentenced to serve four to 12 months in the county prison on a charge of possession of drug paraphernalia. He received credit for spending two days in prison. Keefer was cited by Patrolman Eugene M. Yourey, Pottsville police.

Willliam Anthony Gudonis, 40, Mount Carmel, had his parole revoked by Stine and he was committed to the county prison to serve out his original sentence without credit for 312 days of liberty. He had pleaded guilty in March 2008 to charges of harassment with lewd telephone calls and was released on probation after serving 30 days in prison. Gudonis was cited by Trooper Michael Marinchak.

Sentenced

Brandon Michael Brown, 25, Ashland, was sentenced by Judge Jacquelyn Russell on charges of possession of heroin and cocaine drugs to serve one to 12 months in the county prison, pay $50 to the Criminal Justice Enhancement Account, $302 in restitution to the Bethlehem Regional Crime Lab, pay $100 to the Substance Abuse Education fund and when releassed on probation to pay a $50 monthly supervision fee. Brown was cited by Patrolman Raymond Horan, Butler Township police.

Wins new trial

Michael Thomas Kane, 25, Pottsville, was granted a new trial by Judge Russell based on after-discovered evidence. The sentence previously imposed last Oct. 21, serve four to eight years in a state correctional institution, and the jury verdict were vacated by the court and he is eligible for bail while he awaits a re-trial on charges of burglary.

Last September a jury returned what the judge called "a rather inconsistent verdict," finding Kane guilty of robbery by force and conspiracy to commit burglary but not guilty of a second count of burlgary and robbery by inflicting bodily injury, simple assault and conspiracy.

Testimony was he conspired with individuals to invade the home of Angus Angst, Pottsville, the early morning of July 14, 2008, assaulted Angst and stole his wallet. Kane denied he was involved claiming he had been home and introduced a witness at a hearing on his motion for a new trial who testified Kane was not involved. The witness had previously refused to testify for fear of incrimination but had a change of heart.

Divorces granted

Richard C. Kubilus, Frackville, was granted a divorce from Dawn M. Kubilus, Reading. They were married Aug. 24, 2006.

Laura L. Rodriguez, Pottsville, was granted a divorce from John M. Rodriguez, Tuscson, Ariz. They were married Feb. 11, 2000.

Revoke bail

Kimberly A. Rodgers, 33, Harrisburg, had her bail revoked by Judge Dolbin and she was committed to the county prison to await trail on 27 charges of forging checks. She was charged by Trooper Chad Smith with theft of nine business checks belonging to the owner of Denny's Hot Rod Bar and Grill in Wayne Township.
