Bruce Hawk taking his appeal to the Supreme Court
Michael Kaspszyk, the Eldred Township solicitor, told the board of supervisors at the regular meeting held after the organizational meeting on Jan. 4, that he received notification on Dec. 21, 2009 that Bruce Hawk has filed a petition for allowance of an appeal with the Supreme Court of Pennsylvania that was dated Dec. 18, 2009. Hawk is contesting the township's description of a racetrack. Kaspszyk also received notification from the Supreme Court of PA, dated Dec. 22, 2009, that the petition had been received and gave Kaspszyk 14 days to file an answer. Kaspszyk said he responded with a Brief in Opposition to Hawk's petition to the State Supreme Court on Dec. 30, 2009. The township is waiting to hear of a decision regarding the allowance for the appeal.
The supervisors approved the following bills: General Fund, $11,545.63; State Fund, $280.26; Form 941 (12/19/09) $2,391.62; Form 941 (1/2/10) $2,216.90; State Withholding, $567.31; Payroll ending Dec. 19, 2009, gross payroll of $9,743.78; Payroll ending Jan. 2, 2010, gross payroll, $8,775.60.
The board approved extensions to April 9, 2010 for: the lands of the Herman Borger Estate Subdivision; lands of Gower Estate Subdivision; Thomas and Wanda Dowling Subdivision Plan.
The Blaine and Nancy Silfies Land Development Plan was approved with conditions. Silfies must provide a copy of the construction agreement to the township before the commencement of any sewage facilities; if there is a waste management disposal contract, Silfies must provide a copy of that contract to the township; Silfies must purchase or pay for the PennDOT traffic speed limit signs for Upper 57 Road, that are to be placed in conjunction with the Traffic Study for Upper 57 Road. Once the signs have been delivered to the township, the Board will enact a resolution to set the speed at 40 mph. Nancy Silfies asked Clair Borger, supervisor and roadmaster to please order the necessary signs and hardware and they will pay for them.
Richard Salter, constable, called and said he would like to see Eldred Township hold a Community Day with child safety kits, finger printing, fire company activities and more. The supervisors thought it was a good idea and will consider it.
At the Eldred Township's board of supervisors' meeting held on Dec. 16, 2009, the board voted and approved unanimously the 2010 General Fund budget in the amount of $723,888 and the State Fund budget in the amount of $111,441.64.
A special supervisors' meeting was held on Dec. 23, 2009. An affidavit that had been prepared, approved, notarized and recorded at the Monroe County Recorder's office to add the Moises Levy and Joel Kuznits' 149.45 acre parcel of property, located along Kuehner Road, to the Eldred Township Agricultural Security Area and was unanimously approved by the supervisors.
