Appeals denied
Two appeals of violations and fines imposed by the Pennsylvania Liquor Control Board have been denied in separate opinions handed down by the county court.
The appeal of Jenny's Tavern Inc., of 1 W. Oak St., Tresckow, was denied in a opinion handed down by President Judge Roger N. Nanovic II. The PLCB fined the tavern for violating liquor code rule for the use of loudspeakers or devices whereby music could be heard outside. The violations occurred on Jan. 25-26, 2008, according to the PLCB citation. A fine of $400 was imposed.
The tavern appealed the citation claiming the music was not loud that it could be heard outside the premises.
Nanovic conducted a hearing in the matter then sustained the decision of the liquor board.
The appeal of David Pereira appealed the denial of the reinstatement of his liquor license in Palmerton. The board declined to reinstate the license until the payment of all outstanding fines and costs. Pereira filed an appeal nunc pro tunc, since the time frame for an appeal had passed.
Nanovic affirmed the action of the PLCB in the matter and denied the appeal.
