Divorces granted
Lisa Ann Boyer, Auburn, was granted a divorce from Matthew R. Boyer, New Ringgold. They were married July 26, 2003.
Ronda L. Zimmerman, Tremont, was granted a divorce from Joseph M. Zimmerman, Johnstown. They were married Dec. 12, 2004.
Michael D. Barnhardt Jr., Llewellyn, Branch Township, was granted a divorce from Amy B. Barnhardt, Pottsville. They were married Nov. 6, 2004.
Richard D. Simmons was granted a divorce from Kailey L. Simmons, both of Tamaqua. They were married May 20, 2008.
John Cooney, Frackville, was granted a divorce from Joy E. Cooney, Minersville. They were married July 14, 2007.
Mark H. Kramer, Tremont, was granted a divorce from Lana J. Kramer, Auburn. They were married Dec. 7, 1996.
Marianne N. Coulson, Girardville, was granted a divorce from Thomas A. Coulson, Pottsville. They were married Oct. 3, 1998.
Guilty pleas
Damian Zimnicki, 29, Tremont, pleaded guilty to delivery of a controlled substance in Ashland and was sentenced by Judge John E Domalakes to serve nine to 24 months in a state correctional facility, pay $100 to the Substance Abuse Education Fund, make restitution of $113 to Bethlehem Regional Lab and pay costs of prosecution.
Zimnicki was cited by Schuylkill County Drug Task Force. On a charge of criminal mischief to a vehicle was given a concurrent 12 months probation sentence and ordered to make restitution of $1,331,20 to Jamie Tyler, Tremont. Zimnicki was cited byTrooper Edward Sanchez last Oct. 16.
Clarence O. Stout, 59, Slatington, pleaded guilty to driving while his operating privileges were suspended and was ordered by Judge Charles M. Miller to pay a fine of $200 plus $50 costs and pay $50 to the Criminal Justice Enhancement Account. Stout was cited by Lt. Steve Durkin, Pottsville police, last April 3.
Denied easement
Reynolds E. and Kimberly A. Jenkins, sought to gain easement rights over properties owned by Thomas and D. Gruver and Nicholas Snitzer in West Brunswick Township.
The Reynolds' own 16.5 acres, the Gruvers 2.5 adjacent acres and Snitzer 1.9 adjacent acres. A non-jury trial was held and Judge Charles M. Miller denied Jenkins' request ruling they failed to prescribe elements necessary to establish a prescriptive easement over the Gruvers and Snitzer's land.
At the court hearing testimony showed the Gruvers had placed a chain across the driveway area which blocked the Jenkins from using the dirt road to their land from Fork Mountain Road. The court ruled no record was submitted to show that Jenkins had a right , title or interest in to or over and across the Gruver and Snitzer land. The Jenkins land was previouisly used as a commercial Christmas tree farm to 1970. Additionally blue spruce trees and limbs for wreaths were harvested for years after the main tree operation ceased by Kimberly Jenkins family members and the dirt road was used to gain entrance to the tree farm. Miller ruled that a use based on permission cannot rippen into a prescriptive use.
Found guilty
Thomas Michael Lucas, 46, an inmate at the state correctional facility in Ryan Township, was found guilty by a jury of possession a small amount of heroin in his cell. Judge Cyrus Palomer Dolbin deferred sentencing to Friday, April 30. Lucas was cited by Trooper Roy Eiler last May 3.
