Michelle L. Kmetz, 1410 W. Norwegian St., Pottsville, started a divorce proceeding against David A. Kmetz, 315 Eugene Ave., Beaver Meadows. They were married Oct. 15. 2000.
Draws jail time
Krystal Marie Lombardo, 24, Shenandoah, who pleaded guilty to driving under the influence (DUI) of alcohol was sentenced by President Judge William E. Baldwin to serve 30 days in the county prison and when released to be placed in the Intermediate Punishment Program (IPP) for four years and 11 months, with the first 90 days of her probation under house arrest with electronic monitoring.
She was also ordered to pay a $12 daily fee, pay a fine of $1,500, pay $300 to the Substance Abuse Education fund, $100 to the Catastrophe fund, $50 to the Criminal Justice Enhancement Account, make restitution of $60 to Schuylkill Medical Center, complete the alcohol highway safe driving school, attend and complete intensive outpatient treatment and driver's license suspended 18 months.
On summary charges of failing to drive on roadway laned for traffic, failing to drive at safe speed and failing to operate vehicle without official inspection certificate was fined $25 each and for failing to wear a seat belt fined $10 plus $200 in costs. Lombardo was cited by Trooper Michael Van Buskirk on Nov. 30, 2010, when stopped on Schuylkill Avenue in Shenandoah.
Bench warrants
Judge James J. Goodman dissolved bench warrants against two defendants and restored their bail.
Francis J. Jablonski, 25, Shenandoah, had his unsecured bail of $5,000 restored. He faces charged with theft of services by allegedly failing to return an air condition he had rented from Lighting Rent-To-Own Store in Shenandoah.
Justin Fisher, 30, Schuylkill Haven, had his bail restored and the court ordered his case be placed on the next criminal trial list. Fisher faces charges of DUI of alcohol and fleeing police.
Revocations
President Judge William Baldwin ruled on probation and parole violations after holding hearings.
Keith Dean Kintzel, 28, Pottsville, had his parole revoked and was recommitted to the county prison and his 425 days of liberty were disallowed and added to his maximum sentence for release. He received credit for spending 51 days in the county prison. Kintzel had pleaded guilty on Nov. 24, 2010, to charges of burglary and criminal mischief.
Devin Wendal Murphy, 18, Schuylkill Haven, had his parole revoked and he was recommitted to the county prison with his 496 days of liberty disallowed and added to his maximum date for release. He received credit for 40 days spent in prison. Murphy was found guilty by a jury on Nov. 4, 2011, of charges of aggravated assault.
Brandon Marvin Merwine, 26, Tremont, had his probation revoked and he was re-sentenced on a charge of disorderly conduct to serve three to 12 months in the county prison with credit for serving 34 days. He had pleaded guilty to the charge on last Nov. 16 and was placed on probation.
William J. Walter, 45, Ashland, had his probation revoked and he was re-sentenced on a charge of altering or forging a documents and plates to serve five to 23 months in the county prison with credit for serving 30 days. He had pleaded guilty to the charge.
Judge John E. Domalakes revoked the probation of Steven Thomas Rhoades, 21, Schuylkill Haven, for violating his probation and was re-sentenced on a charge of possession with intent to deliver a controlled substance to serve six to 23months in the county prison with credit for 85 days. He had pleaded guilty to the charge on Nov, 24, 2010, and was placed on probation.Nov. 16 and was placed on probation.
Order evaluation
Luis Anton Guadalupe, 25, Pottsville, pleaded guilty to charges of possession with intent to delivery a controlled substance in Pottsville, possession of a controlled substance and drug paraphernalia.
Judge Baldwin deferred sentencing until an evaluation is completed to determine if he is eligible to be placed under the state's IPP. The sheriff was ordered to transport Guadalupe to a state corrections facility for the evaluation.
