Quiet title action

The Northeast Investment Group Inc., 1933 State Rt. 903, Jim Thorpe, has filed a quiet title action against Vincent J. and Theresa C. Pasquarelli, Sound Beach, Fla.

The plaintiff states it became owner of a property located at Lot 2018, section E-V, Towamensing Trails, Penn Forest Township, by virtue of a purchase made at a Carbon County Tax Claim Bureau sale. It is seeking final judgment by the court declaring it the legal owner of the property and enjoining the defendants from any and all claims to it.

Credit default

Portfolio Recovery Associates LLC, Norfolk, Va., has filed a civil action against Jeffrey Leslie, 42 W. Chipmunk Trail, Jim Thorpe, alleging credit default.

The suit contends Leslie was indebted to G.E. Capital Retail Bank/Lowe's, July 30, 2006, and has failed to make payment on the account that has a remaining balance of $2,217.08. Portfolio is seeking judgment in that amount, plus the costs of the suit and other relief as the court deems just and reasonable.

Mortgage foreclosure

Santander Bank, N.A., Wilmington, Del., has filed a mortgage foreclosure complaint against Kimberly L. Reitano, a/k/a Kimberly Reitano, and Jennifer A. Welch, both of Philadelphia, over a property at 514 Center St., Jim Thorpe.

The plaintiff was assigned the mortgage by Mortgage Electronic Registration Systems, Inc., as nominee for Sovereign Bank. The complaint states the defendant is in default of the terms of the mortgage since Jan. 1, 2012.

Sought is judgment in the amount of $95,438.57 plus interest and costs.

U.S. Bank, N.A., as trustee for J.P. Morgan Mortgage Acquisition Trust, c/o Wells Fargo Bank, Ft. Mill, S.C., has filed a mortgage foreclosure complaint against Anthony Nunnari, 134 Mountain Road, Albrightsville, over a property at that address.

The complaint states the defendant is in default of the terms of the mortgage since Dec. 1, 2011. Sought is judgment in the amount of $130,640.49 plus interest and costs.

U.S. Bank N.A., Owensboro, Ky., has filed a mortgage foreclosure complaint against Heath C. and Michelle L. Bullard, 16 Kittatinny Lane, Lehighton, over property at that address. The suit contends the Bullards has been in default of the terms of the mortgage since Sept. 19, 2013. Sought is judgment in the amount of $233,064.77 plus interest and costs.

Utility action

PPL Electric Utilities Corporation, Allentown, has filed a civil action against John M. Shamro of Long Pond, and Laura P. Lanotte of Pocono Summit.

The suit contends on Dec. 18, 2011, Shamro was operating a vehicle owned by Lanotte that struck and damaged a utility pole and overhead facilities owned by the plaintiff in the vicinity of 6 Indian Mountain Lakes, Albrightsville.

The utility is seeking judgment in the amount of $6,700.83, plus costs, interest, punitive damages and delay damages.

Wants development

easement granted

Deborah R. and J. Calvin Williams Jr., 2 Holmes Way, Albrightsville, have filed a complaint to establish a prescriptive easement on a parcel in the Towamensing Trails development, Penn Forest Township, against Frank Ostafin, 114 Whitman Lane, Albrightsville, and Maspeth, N.Y.

The plaintiffs states they have owned their home, located on Lot 1483 in the development, since Dec. 20, 1994, having purchased it from Deborah's parents, Albert B. II and Jacqueline W. Root, who built the home in 1980. The suit contends they, and others, have continuously and regularly utilized a path crossing Lot 1441 since 1980, and that the use has been without challenge until 2012.

The plaintiffs contend the defendant purchased Lot 1441 at a tax sale in 2005 and did so subject to the caveat of "buyer beware."

They are asking to court to grant an easement to them, enjoining the defendant from interfering with the use of the path, which, they say, provides access to the club facilities, playground, beach and other facilities of Towamensing Trails.

Credit default

Portfolio Recovery Associates, LLC, Norfolk, Va., has filed a civil action against Deborah Abraham, 221 Cherry Lane, Albrightsville, alleging credit default.

The suit contends Abraham was indebted to G.E. Capital Retail Bank/General Electric Capital Corp./Ashley Furniture, on Sept. 11, 2011, and has failed to make payment on the account that has a remaining balance of $2,317.44. Portfolio is seeking judgment in that amount, plus the costs of the suit and other relief as the court deems just and reasonable.

Portfolio Recovery Associates LLC, c/o Blatt, Hasenmiller, Leibsker & Moore LLC, Philadelphia, has filed a civil action against Roy Barnes, 192 Wild Creek Drive, Jim Thorpe, for credit default.

The suit contends Barnes obtained extensions of credit with Citibank, N.A., Sears, agreeing to make monthly payments as required by the terms of the account, and has failed to make the payment.

The account that has a remaining balance of $1,808.07. Portfolio is seeking judgment in that amount, plus the costs.

Utility is seeking

payment for damages

PPL Electric Utilities Corporation, Allentown, has filed a civil action against John J. Streff Jr., and "John Doe," 91 Aspen Drive, Albrightsville, seeking to be made whole for damages and costs it incurred as a result of an automobile accident.

The suit contends on Dec. 24, 2011, "John Doe" was operating a vehicle owned by Streff that struck and damaged a utility pole and overhead facilities owned by the plaintiff in the vicinity of Stony Mountain Road, Albrightsville.

The utility is seeking judgment in the amount of $20,679.81, plus costs, interest, punitive damages and delay damages.

Premises liability

Randy Weber, P.O. Box 269, Slatington, has started a premises liability lawsuit against Anthony A. Montanari, d/b/a TJ's Construction Company, Weston, Pa.

The suit, started by the filing of a writ of summons in which the specific allegations are not yet divulged, seeks a trial by jury.

Attorney Frank G. Procyk, Allentown, is representing the plaintiff.

Complaint

in ejectment

U.S. Bank, N.A., as trustee for Ocwen Loan servicing, LLC, West Palm Beach, Fla., has filed a complaint in ejectment against Ralph G. Williams, 54 Vista Drive, Albrightsville, and John Doe, identified as unknown adults living in the residence at that premises.

The complaint contends the Carbon County Sheriff's office sold the above-listed property on Oct. 11, 2013, by virtue of a writ of execution issued by the Court of Common Pleas, and that U.S. Bank, on Nov. 4, 2013, settler with the sheriff, resulting in a deed to the property being duly recorded on that date in the office of the recorder of deeds.

The complaint asks the court to enter a judgment ejectment against the defendants who are presently in possession of the property.

Employment dispute

A lawsuit filed in Carbon County Court seeks a jury trial over an employment dispute.

The action was started by a writ of summons which, unlike a complaint, does not contain specific allegations.

The plaintiff is a Robert W. Moore, who is represented by Atty. Donald P. Russo, Bethlehem. Named as the defendant is Air Methods, Inc., Englewood, Colo., and P.H.P.A. O.P.E.I.U. Local 109, Daleville, Ala.

Sues over crash

Denise and Scott Koder, 235 Hemlock Trail, Lehighton, have filed a two-count claim, seeking $50,000 in compensation on each charge, against Ashley Schirer, 38 E. Fell St., Summit Hill, claiming injuries and damages stemming from a motor vehicle accident.

The plaintiffs allege Schirer was operating a motor vehicle at 3:30 p.m. Sept. 16, 2012, on Pohopoco Drive, Franklin Township, that failed to stop in time and violently struck the rear of a vehicle that was being driven by Denise Koder.

The suit alleges negligence and carelessness that the plaintiffs say caused severe injuries to Denise Koder that are permanent in nature.

The second count of the complaint if filed in behalf of Scott Koder, contending the accident injuries have caused him to suffer the loss of consortium of his wife.

Credit card bill

Midland Funding LLC, San Diego, Calif., has filed a credit card default action against Brenda Levan, 307 Main Road, Lehighton.

The suit says Levan is the owner of a Webbank account through Midland Credit Management, and that the defendant has failed to pay on the balance since Nov. 4, 2013.

The plaintiff is seeking judgment in the amount of $1,068.21 plus the costs of the action
