Seek gun forfeiture

A petition was filed in the county court by District Attorney Karen Byrnes Noon seeking a court order for destruction of a 9mm model handgun which was confiscated by Trooper Melissa Kyper from Dillon Patrick Fogarty, of Shenandoah, after a drive-by shooting in Barnesville, Ryan Township, Jan. 16, 2012.

The petition states two shots were fired from a moving vehicle which struck the home of Christopher Jadosh, 221 Church St., Barnesville, Ryan Township.

One bullet went through a double panel glass window and another bullet entered the home through the extended vinyl siding. No one was injured.

Fogarty pleaded guilty on Nov. 14, 2012, and is currently serving a sentence of 30 to 60 months in a state correctional facility. The petition asked for forfeiture of the weapon and for the police to destroy it.

Seek back taxes

Tamaqua Area School District filed a petition to court to enter a judgement against Charles T. and JoAnn Rodgers, of 209 Orwigsburg St., Tamaqua, claiming they owe $878.70 in back school taxes on property at 148 Penn St., Tamaqua.

Panther Valley School District filed a petition to court to enter a judgement against Frieda B. Wagner claiming she owes back school taxes of $1,758.55 on property at 48-50 Greenwood Street, Coaldale, and $1,302.08 on property at 103 W. Miner St., Coaldale.

Reclaimof motorcycle

Harley Davidson Credit Corporation, Carson City, N.Y., filed suit against Terry White, 275 Van Gelder St., Tamaqua, alleging White signed over a promissory note for the purchase of a motorcycle and that he failed to live up to the agreement of monthly payments and is in default of $9,487.03. The firm seeks repossession of the motorcycle.

Wins appeal

Brian Kolbush, 53, of 18 S. Logan St., McAdoo, won his appeal from a charge of criminal mischief to metal grates on Butler Street, McAdoo

Judge John E. Domalakes overturned the guilty verdict imposed by a magisterial district judge and the fine of $100 and costs was ordered returned to Kolbush.

Mortgage default

Wells Fargo Bank, N.A., Fort Mills, S.C., filed suit against Thomas R. and Patricia A. Zemanik, 230 Market St., Tamaqua, alleging they have defaulted on mortgage payments on their property and seek a judgment for $93,970.24 plus interest and costs.

Credit default

Resmit Corporation, Bloomsburg, filed suit against Charles A. Bachorik, 201 Schuylkill Avenue, Tamaqua, alleging he has defaulted on his credit card payments and seeks a judgment for $16,296.95 together with interest and costs.
