Bail hearing
Peter M. Clive, 40, Saint Clair, had his bail reduced to $50,000 unsecured by Senior Judge D. Michael Stine and subjected him to special conditions, reside at 1100 E. Wyomissing Blvd., Reading, and is not to relocate without prior court approval, shall not consume, possess or transport any alcohol or drugs and must seek gainful employment. Clive faces charges of aggravated and simple assault, recklessly endangering another person, and terroristic threats.
Divorces granted
Adrienne Harig, Tremont, was granted a divorce from Chad Harig, Schuylkill Haven. They were married June 11, 2011.
James Q. Correll, Orwigsburg, was granted a divorce from Jennier Anne Correll, Pottsville. They were married July 30, 2005.
Glenn R. Bensinger, Pitman, Eldred Township, was granted a divorce from Rose A. Miller, Hegins, Hegins Township. No marriage date as they lived under common law.
Plea guilty
Jason Jerome Dahm, 32, of 732 Broad St., Tuscarora, Schuylkill County, pleaded guilty to a charge of possession of a controlled substance and drug paraphernalia and was sentenced by Judge Cyrus Palmer Dolbin on the possession charge to serve three to 12 months in the county prison, pay $100 to the Substance Abuse Education fund, $50 to the Criminal Justice Enhancement Account fund, pay a $50 monthly supervision fee, and make restitution of $113 to the Bethlehem Regional Lab. On the charge of possession of drug paraphernalia he was given a concurrent sentence and make an additional payment of $100 to the SAE fund and $50 to the CJEA fund.
Dahm was cited by Rush Township Patrolman Adam Sinton, last April 12 at the Tuscarora State Park. Back in July 2011 he pleaded guilty to retail theft of a play station from Kmart store in the Schuylkill Mall and was placed on probation by Judge Jacqueline Russell.
Dismiss charges
Charges of driving under the influence (DUI) and driving while his license were suspended which were filed against George Michael Cope, 26, of Reading, were dismissed by President Judge William E. Baldwin on motion filed by District Attorney Karen Byrnes Noon who told the court she could not prosecute as the arresting officer is deceased. Cope was cited by the late Tamaqua Patrolman Matthew Bynon.
Charges of simple assault and disorderly conduct were dismissed against Shawn Allen Jessman, 20, Frackville, by Baldwin on motion of Noon who claimed the victim did not wish to prosecute.
Terminate program
Jeremy M. Lutz, 29, Minersville, was removed from the Accelerated Rehabilitation Dispositin (ARD) probation program by Judge John E. Domalakes for violating the rules. He was serving a 12 months probation, having been placed in the program by Domalakes last February. The program is for first offenders to allow them to serve a probation period and then the charges are dropped.
Lutz now faces trial on a charge of recklessly endangering another person for firing a rifle in the area of where his girlfriend resided, according to Trooper David Beam, the arresting officer.
Revocations
Tedd Richard Fredericks, 40, Frackville, had his parole revoked by Judge Domalakes and he was remanded to the county prison to serve the balance of his sentence. His 477 days of liberty was disallowed creating a new maximum date for release from prison moved to July 4, 2014.
The court ruled he was eligible to participate in the Vocational Rehabilitation Program in the prison but cannot re-apply for parole before Aug. 6, 2013.
Fredericks pleaded guilty in August 2010 to a charge of theft from a motor vehicle and was sentenced to serve six to 23 months in prison. This was his second parole revocation.
Jorge David Ortiz-Rivera, 47, Pottsville, had his parole revoked by Domalakes and was committed to the county prison to serve the balance of his sentence and his 286 days of liberty disallowed and added to his maximum date for release from prison which was extended to July 29, 2014, however, he is eligible to apply for re-parole contingent upon acceptance into the Salvation Army Adult Rehabilitation Center and successfully completes a six months program. He pleaded guilty to credit card fraud and served 35 days in prison and was released on parole.
Diane Marie Kutsko, 42, Shenandoah, had her parole revoked by Judge Charles M. Miller and she was remanded to the county prison to serve the balance of her sentence and her 315 days of liberty disallowed and added to her maximum date for release which was extended to Sept. 6. The court ordered while she is incarcerated she must obtain a drug and alcohol evaluation and if qualified to enter an inpatient treatment facility may apply for re-parole. Kutsko pleaded guilty to drug charges and was placed on probation.
James Robert Shivelhood, 32, Locustdale, had his probation revoked by Miller and was recommitted to the county prison with 402 days of liberty disallowed and his maximum date for release from prison extended to July 15, 2014, and he must obtain drug and alcohol and mental health evaluation. He pleaded guilty in November 2011 to forgery and drug charges and was placed on probation for two years. This was his second revocation.
Nicholas James Garulle, 23, Mahanoy City, had his parole revoked but was inmmediately paroled to the Salvation Army Rehabilitation Center to complete a program. He pleaded guilty in June 2011 receiving a stolen all terrain vehicle (ATV) and attempted to sell it. This was his second revocation.
