Not guilty of DUI
David Allen Morgan, 44, Schuylkill Haven, was found not guilty of driving under the influence (DUI) of alcohol by a jury, however, Judge John E. Domalakes found him guilty of public drunkenness and fined him $300 plus costs.
At the trial Trooper Mark W. Knock testified he was called to Redner's Warehouse Market, off SR61, near Schuylkill Haven, because a patron was bothering other customers. The trooper found Morgan shopping in the grocery aisle and noticed blood shot eyes, slurring speech, and the smell of alcohol and charged him with dui.
The jury felt since he was not driving at the time of his arrest he was not guilty of the charge.
Suppress charges
Nicholas Robert Phillips, 23, Cressona, had drug charges dismissed on motion of District Attorney Karen Byrnes Noon because the evidence was suppressed by a county judge. President Judge William E. Baldwin granted the motion.
Phillips was charged by Orwigsburg Patrolmanm Michael Fogerty, who camed upon him parked in a car late at night behind the vacant building of the former Madeline's Restaurant which was closed after a fire. Phillips filed a motion to suppress and the court ruled he was illegally detained and the evidence obtained must be suppressed.
