Suit for damages
Richard and Constance Kistler, 52 Todd Lane, Lehighton, filed a civil action against Health Solutions Inc., 101 S. 10th St., Lehighton, a business of selling, assembling, distribution and/or installing home medical equipment.
The suit states on June 19, 2013, the plaintiffs purchased a product (oxygen tank) from the defendant which was delivered, set up and maintained by the defendant.
On that date, the suit alleges, the tank leaked oxygen, which ignited due to, among other things, a defective seal and/or contaminates within the product. This caused an explosion and fire causing extensive damages that are detailed in the suit.
Negligence, breach of warranties and other allegations are made and sought are damages in excess of $50,000 on each of three counts.
