Prothonotary'sreport

A total of 326 cases were started in May in the office of Carbon County Prothonotary Joann M. Behrens, according to a monthly statistical report released by the officeholder. A breakdown of the cases is as follows:

Civil actions, 25; custody complaints, 13; district justice appeals, 4; divorce complaints, 20; complaints in ejectment, 2; eminent domain/petitions for views, 2; license appeal, 1; mandamus action, 1; mortgage foreclosure complaints, 36; name change petition, 1; protection from abuse petitions, 32; replevin complaint, 1; quiet title action, 2; judgments, 182; miscellaneous cases, 2; and stipulations/waivers of liens, 2. The office staff also received and processed 104 applications for U.S. passports.

Behrens' financial report shows that $29,709.65 was generated as follows: prothonotary's fees, $24,896.19; interest income, $0.96; custody fee, $550; data processing, $4,162.50; PFA surcharge, courts, $50; and PFA surcharge, Sheriff, $50.

The prothonotary also remitted $3,325.23 to the Commonwealth of Pennsylvania, Department of Revenue, representing state fees collected locally, and $42 to the Administrative Offices of the Pennsylvania Courts, this being surcharges on new custody cases in accordance with Act 119 of 1996. Another $1,050 was deposited in the Prothonotary's Automation Fund for future use in automating the office.

Mortgageforeclosures

The following actions were filed as mortgage foreclosures for alleged defaults on loans.

Bank of America, c/o 400 National Way, Simi Valley, Calif., filed against Philip C. Deemer Jr., 110 Bridge St., Lehighton, over property at that address. Sought is $72,243.84 and continuing interest.

Bank of America filed an action against Ellen Bobak Adams, 159 S. Fourth St., Lehighton, over property at that address. Sought is $93,935.82 and continuing interest.

Bank of America filed an action against Felix J. Abreu Jr., Lot 168, Reed Court, aka, 19 Reed Court, Albrightsville, over property at that address. Sought is $321,966.94 and continuing interest.

U.S. Bank National Association, c/o 3815 South West Temple, Salt Lake City, Utah, filed an action against Charles E. Ruch Jr., 236 S. Second St., Lehighton, over property at that address. Sought is $131,913.99 and continuing interest.

M&T Bank, c/o One Fountain Plaza, Buffalo, N.Y., filed an action against Frances A. and Timothy E. Delaney, 205 E. Kline Ave., Lansford, over property at that address. Sought is $50,994.45 and continuing interest.

Nationstar Mortgage, c/o 350 Highland Drive, Lewisville, Tex., filed an action against Sean R. Trinkle, 258 E. Kline Ave., Lansford, over property at that address. Sought is $39,303.62 and continuing interest.

Wells Fargo Bank, c/o Box 65250, Salt Lake City, Utah, filed against George M. Maehrer III, in his capacity as personal representative of the estates of Ann and George Maehrer, over property at Lot 6, Old Stage Road, Albrigthsville. Sought is $126,457.89 and continuing interest.

Credit defaults

The following actions were filed by credit card companies, or their collection agencies, for alleged defaults on credit card/loan accounts.

MSW Capital One, Carnegie, filed against Kevin Smith, 1265 Green St., Lehighton. Sought is $1,422.35.

TD Bank, Carnegie, filed against Marisa C. Rutkowitz, 675 Firehouse Rd., Palmerton. Sought is $9,291.38.

Capital One Bank, Richmond, Va., filed against Brian S. Romanchik, 204 W. Front St., Lansford. Sought is $1,494.62.

LVNV Funding, Greenville, S.C., filed against Anne Fava, 11 Matthew Lane, Kunkletown. Sought is $3,424.79.

Assault/battery

Barry Weinstein, 217 Thompson St., New York City, N.Y., has filed a civil complaint against Rashundal Yuhas, 15 W. Ninth St., Jim Thorpe.

The suit claims assault and battery was inflicted on Weinstein by Yuhas in June 2013 in Jim Thorpe. No specific location was stated in the suit.

The suit states Weinstein was punched in the face by the defendant and suffered injuries, detailed in the suit, that required medical assistance at a hospital and were severe in nature and also caused the plaintiff emotional harm.

Sought are damages in excess of $50,000 plus the payment of medical bills, interest, and costs.
