Judgments recorded
Midland Funding LLC, Philadelphia, has filed a transcript of judgment against Peggy Holtzinger, 548 Lehigh Ave., Palmerton, which was entered in October by Magisterial District Judge William Kissner, Palmerton.
Midland states it is the owner of a credit card account with Holtzinger by virtue of assignment of the account, during which time the defendant defaulted.
The judgment is in the amount of $9,221,64, including a civil judgment of $9,075.14 and $146.50 in filing fees.
Wargo Coal and Oil Delivery, McAdoo, has recorded a judgment entered in its favor on Nov. 19, 2015, by Magisterial District Judge Joseph Homanko Sr., Weatherly, against Crystal and Michael J. Tracy, 18 E. Market St., Tresckow.
The judgment is in the amount of $315.28, including a civil judgment of $219.78 plus filing fees of $95.50.
Student loan costs
National Collegiate Student Loan Trust 2004-2, Norcross, Georgia, has filed a civil action against Michael F. and Michael Jucewicz, 810 Gilberts Hill Road, Lehighton, seeking repayment of funds it says the defendants received to pay tuition costs.
The suit states the defendants executed a loan request/credit agreement with the plaintiff, which advanced the proceeds of the loan to the borrowers to be used for educational purposes, and that the defendants have not lived up to the terms of the agreement by making payments on the loan.
Sought is judgment in the amount of $16,285.89, plus costs and other relief deemed appropriate by the court.
Municipal liens
The Borough of Beaver Meadows filed municipal lien claims against individuals for unpaid water bills, including:
Krista Dean, owner of a property at 43 Penrose St., $953.61.
Elizabeth Kress, Drums, owner of a property at 44 Church St., $357.31.
PA tax lien filed
The Commonwealth of Pennsylvania, Department of Labor and Industry, Harrisburg, has filed a liens against Thomas J. Shupp, individually, and trading as Log Home Sanding and Stain LLC, 210 Bartholomew Drive, Palmerton.
The lien is in the amount of $736.25, representing employee and employee withholdings to the use of the state's Unemployment Compensation Fund. A $1,000 civil penalty has also been assessed by the department.
Store is sued
Michael McLaughlin, 133 W. Ridge St., Nesquehoning, has started a civil action against the Dollar General store, 1125 E. Catawissa St., Nesquehoning, and Providence Properties LLC, Frackville.
The suit, started by the filing of a writ of summons in which the pleadings in the case need not be specified at this time, is listed as a premises liability claim in which money damages are requested outside the court's arbitration limits of $25,000. A jury trial is demanded.
Mortgage foreclosure
J.P. Morgan Mortgage Acquisition Corporation, Santa Ana, California, has filed a mortgage foreclosure complaint against Troy L. Jr. and Rachel C. Moyer, 340 W. Abbott St., Lansford, over a property at that address.
The plaintiff is seeking judgment in the amount of $32,345.78 in its favor, plus interest, fees and costs.
Complaint in ejectment
Maria T. Zumar, Berwick, has filed a complaint in ejectment against Luis Diaz, 538 Brenkman Drive, Weatherly, seeking an order restoring possession of the premises at the above address to the plaintiff, judgment in excess of $50,000 and any other relief the court deems just and proper.
The complaint states the plaintiff acquired title to the premises along Brenkman Drive on or about April 13, 1999, and that on or about April 29, 2014, the defendant entered upon the premises and began to use and occupy the residential dwelling to the exclusion of the plaintiff.
