Credit account owed

Calvary SPV 1 LLC, has filed a debt collection complaint against Rosanna Rufrano, 19 Apache Way, Jim Thorpe.

The complaint alleges the defendant is in default of a GE Capital Retail Bank/QCARD account in the amount of $2,031.15.

Motion for partition

Alessio J. Paredes, Ogdensburg, New Jersey, has filed a complaint in partition against Roland Paredes, P.O. Box 604, Albrightsville, asking the court to partition property the two parties jointly own at Lot 134, Section B, Holiday Poconos, Albrightsville. In addition, the plaintiff wants the court to order the defendant to provide an accounting of rents and other profits or benefits received from renting the property, and to make restitution for benefits due to the unjust enrichment of the defendant.

The motion states since the time the two parties took ownership of the property, the defendant has maintained the premises as his home and has been the sole occupier of the property to the exclusion of the plaintiff, during which time the plaintiff has incurred all of the costs of taxes, dues, property owners' assessments and other costs. The plaintiff says the defendant has failed to pay his fair share of the costs, maintenance, taxes and insurance on the property, and has also rented the property for $1,000 per month, representing unjust enrichment on his behalf.

The plaintiff said the defendant has failed to pay fair and reasonable rental value of the property even though he has lived in the premises since 2010.

Complaint in ejectment

HSBC Bank, U.S.A., N.A., Depew, New York, has filed a complaint in ejectment against Jose Cotto, 1638 Pautuxent Trail, Penn Forest Township.

The plaintiff states it acquired title to the foreclosed premises at the above address at a sheriff's sale conducted July 10, 2015, and that the defendant continued to be in possession of the property without right and claim.

HSBC asks the court to enter judgment for immediate possession of the property, plus costs and disbursements.

Owes gas bill

Heller's Gas, Berwick, has recorded a judgment entered in its favor by a Magisterial District Court Judge against Ali Capobianco Sr., 15 E. Point Road, Albrightsville.

The judgment was awarded on April 9 by Magisterial District Judge Colleen Mancuso in the amount of $140.50.

MDJ appeal

The Palmerton Community Ambulance, through its attorney, the Hamilton Law Group, Allentown, has filed an appeal of a default judgment entered by Magisterial District Judge William Kissner in favor of Brian E. and Michelle A. Crawn, 149 E. Catawissa St., Nesquehoning.

The plaintiff seeks a decision in its appeal that is within the court's $50,000 limits of arbitration. Judge Kissner ruled on the default judgment on Aug. 31.
