The plaintiff states Kasprzak was the operator of a motor vehicle in the 400 block of East Broad Street in Tamaqua on Feb. 18, 2015, when it was involved in a collision allegedly caused by the negligence, recklessness and/or carelessness of a "tortfeasor," Phantom Vehicle, resulting in him suffering serious, severe and permanent bodily injuries.
Kasprzak states upon information and belief, the tortfeasor's automobile insurance carrier may assert that, at the time of the collision, the tortfeasor's vehicle was not covered by any policy of insurance issued by the defendant.
If it is found that averment is true, the complaint states, Kasprzak asserts an Uninsured Motorist Claim against the defendant, which is applicable coverage in his policy.
