Carbon County court – ARD
Six defendants in pending criminal cases were placed in Carbon County’s Accelerated Rehabilitation Disposition probation program on Thursday by Judge Steven R. Serfass.
If a person successfully completes all conditions of the program their record is wiped clean. However, if they fail to complete it, or are revoked from it, they then would face trial on all pending charges. A person does not admit guilt in entering the program.
All were placed for a year, unless otherwise noted.
Dominic G. Buzzetta, 30, of Lehighton, was placed on a charge of possession with intent to deliver a controlled substance. He was arrested on Oct. 14, 2015, by state police at Hazleton along Route 903 in Penn Forest Township. Marijuana was found.
He was assessed $650 for the cost of the program and ordered to get a drug and alcohol evaluation and follow any recommendation for treatment and render 50 hours of community service.
Matthew B. Schaeffer, 49, of Lehighton, was placed on a driving under the influence charge. He was arrested on Jan. 4 by Lehighton police along Alum Street. A test revealed a 0.22 BAC.
He was assessed $650 and ordered to render 50 hours of community service and his license was suspended for 60 days.
Tyler Steven Bailer, 25, of Lehighton, was placed on a DUI charge. He was arrested on June 29 by Lehighton police long Route 443. A test revealed the presence of a controlled substance.
He was assessed $600 and ordered to render 50 hours of community service and his license was suspended for 60 days.
Hailey Lynn Gombert, 21, of Lehighton, was placed for two years on a charge of possession with intent to deliver a controlled substance — heroin. She was arrested on Aug. 4 by Lehighton police in the lower park area.
She was assessed $450 and ordered to render 100 hours of community service, forfeit $1,125 found on her at the time of the arrest, get a D&A evaluation and zero tolerance for drug or alcohol use.
Krys Michael Haupt, 51, of Lehighton, was placed on a DUI charge. He was arrested on Feb. 16 by state police at Lehighton along Route 443 in Lehighton. A test revealed the presence of a controlled substance.
He was assessed $600 and ordered to render 50 hours of community service, and his license was suspended for 60 days.
Joseph McDermott, 54, of Albrightsville, was placed on a DUI charge. He was arrested on June 3 along Route 903 in Penn Forest Township by state police at Fern Ridge. A test revealed a 0.21 BAC.
He was assessed $550 and ordered to render 50 hours of community service and his license was suspended for 60 days.
Each defendant must also pay court costs of about $1,000, a $50 per month supervision fee while in the program and those charged with DUI must follow any recommendation of their drug and alcohol evaluation.
