Carbon County court – ARD
Six defendants in pending drunken driving cases entered guilty pleas in Carbon County court on Monday to charges of driving under the influence.
Judge Joseph J. Matika accepted the pleas from the following:
Brianna Rose Wludyka, 23, of Hazleton, was arrested on July 13 by state police at Hazleton along Main Street in Banks Township. A test revealed a 0.22 BAC. She also pleaded to recklessly endangering another person.
On the DUI count Matika sentenced her to serve 48 hours to six months in jail, a fine of $500, one-year license suspension, pay court costs of about $1,000, pay a $50 per month supervision fee while on parole, follow any recommendation of her drug and alcohol evaluation and render a total of 50 hours of community service. On the second count she was placed on probation for a year, concurrent with the DUI charge.
She will began the jail term at 9 a.m. on Nov. 28.
Justin Mooney, 29, of Lehighton, was arrested on June 6 by Lehighton police along Route 443. A test revealed the presence of a controlled substance.
Sentencing was deferred so Mooney can obtain a drug and alcohol evaluation.
Megan Marie Welsh, 25, of Lehighton, was arrested on Aug. 24 by Mahoning Township police along Mahoning Drive East. She refused a blood test.
Sentencing was deferred as Welsh needs to obtain a comprehensive drug and alcohol evaluation.
Thomas B. Hosler, 55, of Tamaqua, was arrested on July 2, 2017, by Lansford police along Bertsch Street. The test revealed a 0.14 BAC.
He also pleaded to one count of simple assault for an incident stemming from the same stop.
On the DUI count, a first offense, he was placed on probation for six months and ordered to pay a fine of $300 and render a total of 50 hours of community service. On the assault count he was placed on probation for a year and ordered to attend and successfully complete anger management counseling and have no contact with the victim. He must also pay court costs of about $1,000, a $50 per month supervision fee while on probation and follow any recommendation of his drug and alcohol evaluation.
Marcio O. Silva, 37, of Albrightsville, was arrested on Oct. 18, 2015, by Kidder Township police along Route 903 in Albrightsville. A test revealed a 0.15 BAC. He was previously placed in the county’s Accelerated Rehabilitation Disposition probation program but was revoked from it for violating conditions.
Sentencing was deferred so Silva can obtain a comprehensive drug and alcohol evaluation.
Norman Patrick Saylor, 51, of Lehighton, was arrested on May 6 by Mahoning Township police along Mahoning Mountain Road. He refused a blood test.
Sentencing was deferred so he can obtain a drug and alcohol evaluation and also apply for the IPP.
