Carbon County court – ARD

Eleven first-time offenders in the criminal justice system were placed in Carbon County’s Accelerated Rehabilitation Disposition probation program last Friday by Judge Joseph J. Matika on charges of driving under the influence and related counts.

If a person successfully completes all conditions of the program their record is wiped clean. However, if they fail to complete the program, or are revoked from it, they would face trial on all pending charges. A person does not admit guilt in entering the program.

All were placed for a year.

Julio Sezar Alvarado, 23, of Lansford, was arrested on March 13 by Lansford police along Bertsch Street. A test revealed the presence of a controlled substance.

He was assessed $600 for the cost of the program and ordered to render 50 hours of community service.

David Bruce Cathers, 50, of Lehighton, was arrested on April 11 by Franklin Township police along Route 2015. A test revealed a 0.12 BAC.

He was assessed $500 and ordered to render 50 hours of community service and license suspended for 60 days.

Christina M. Hartman, 53, of Palmerton, was arrested on Dec. 28, 2018, by state police at Lehighton along Hemlock Street in Franklin Township. A test revealed the presence of a controlled substance.

She was assessed $600 and ordered to render 50 hours of community service and license suspended for 60 days.

Josephine Margaret Hettrick, 18, of Lansford, was arrested on May 13 along Mahoning West Drive by Mahoning Township police. A test revealed the presence of a controlled substance.

She was assessed $600 and ordered to render 50 hours of community service and license suspended for 90 days.

Edward Gary Higgins, 22, of Andreas, was arrested on May 25 by state police at Lehighton along Fireline Road in Lower Towamensing Township. A test revealed a 0.08 BAC.

He was assessed $450 and ordered to render 50 hours of community service.

Derek Kuklentz, 28, of Selinsgrove, Snyder County, was arrested on May 5 by state police at Lehighton in Bowmanstown. A test revealed a 0.12 BAC.

He was assessed $500 and ordered to render 50 hours of community service and license suspended for 30 days.

Crystal Adiani Putalvage, 21, of Lansford, was arrested on March 29 by Lansford police along Snyder Avenue. A test revealed the presence of a controlled substance.

She was assessed $600 and ordered to render 50 hours of community service and license suspended for 90 days.

Nikelle Leigh Schleicher, 28, of Palmerton, was arrested on April 19 by state police at Lehighton, along Forest Inn Road in Towamensing Township. A test revealed a 0.11 BAC.

She was assessed $650 and ordered to render 50 hours of community service and license suspended for 30 days.

Danielle Ann Uyvari, 35, of Lehighton, was arrested on Feb. 16 along Dieters Hill Road in East Penn Township. A test revealed a 0.20 BAC.

She was assessed $550 and ordered to render 50 hours of community service and license suspended for 60 days.

Enrique Velazquez, 27, of Kunkletown, was arrested on March 20 along Stagecoach Road in Towamensing Township by state police at Lehighton. A test showed the presence of a controlled substance.

He was assessed $600 and ordered to render 50 hours of community service and license suspended for 60 days.

Michael J. Weaver, 45, of Nesquehoning, was arrested on May 28 along Coal Street by Lehighton police. A test revealed the presence of a controlled substance.

He was assessed $600 and ordered to render 50 hours of community service and license suspended for 60 days.

Each defendant must also pay court costs of about $1,000, a $50 per month supervision fee while in the program and follow any recommendation of their drug and alcohol evaluation.

I'd love to know how the state can claim they are a victim to these victimless crimes. You can say "there could have been victims", but guess what? There wasn't. DUI was not considered a criminal offense until the late 90's when the militarization of our police departments began and they needed a way to support their spending.
