Carbon County court – ARD

Seven defendants in pending criminal cases were placed in Carbon County’s Accelerated Rehabilitation Disposition probation program on Monday by Judge Joseph J. Matika.

If a person successfully completes all conditions of the program, their record is wiped clean. However, if they fail to complete it, or are revoked from it, they then would face trial on all pending charges. A person does not admit guilt in entering the program.

All were placed for a year, unless otherwise noted:

Ludwig Terrance Auch-Schwelk, 44, of Albrightsville, was placed on a charge of driving under the influence. He was arrested on Feb. 2 by state police at Fern Ridge along Route 903 in Kidder Township. A test revealed the presence of a controlled substance.

He was assessed $650 for the cost of the program and ordered to render 50 hours of community service and his license was suspended for 60 days.

Alec Elton Focht, 26, of Lansford, was placed for six months on a charge of possession of drug paraphernalia. He was arrested on Oct. 4 by Lansford police along West Dock Street.

He was assessed $450 and ordered to render 25 hours of community service.

Joshua E. Makowiec, 34, of Weatherly, was placed on a charge of resisting arrest and related counts. He was arrested on Aug. 4 by state police at Hazleton along Packer Drive in Packer Township.

He was assessed $450 and ordered to render 50 hours of community service and obtain a mental health evaluation and follow any recommendation for treatment.

Tyler Lee Miller, 21, of Lansford, was placed for two years on charges of terroristic threats and related counts. He was arrested on Oct. 6 by Lansford police for an incident in the 400 block of East Bertsch Street involving a female victim.

He was assessed $450 and ordered to render 100 hours of community service and obtain a mental health evaluation.

Marie Ruslavage, 47, of Lansford, was placed for 18 months on a charge of simple assault. She was arrested on Aug. 15 by Lansford police for an incident in the 200 block of West Patterson Street, and officer Jarrod J. Bulger the listed victim.

She was assessed $650 and ordered he render 75 hours of community service and obtain a drug and alcohol evaluation.

Anthony Joseph Uliano, 18, of Sugarloaf, Luzerne County, was placed on a charge of possession of marijuana. He was arrested on June 5 by Weatherly police along Jefferson Street following a traffic stop.

He was assessed $450 and ordered to render 50 hours of community service.

Aaron Yanchura, 22, of Nesquehoning, was placed on a charge of possession of drug paraphernalia. He was arrested on May 17 by Nesquehoning police on Park Avenue following the execution of a search warrant.

He was assessed $650 and ordered to render 50 hours of community service and obtain a drug and alcohol evaluation.

Each defendant must also pay court costs of about $1,000, a $50 per month supervision fee while in the program and those charged with DUI must follow any recommendation of their drug and alcohol evaluation.
