Carbon County court – ARD

Twelve first-time offenders in the criminal justice system were placed in Carbon County’s Accelerated Rehabilitation Disposition probation program on Thursday.

Eleven were placed on driving under the influence charges during the court’s DUI court session.

If a person successfully completes all conditions of the program, their record is wiped clean. However, if they fail to complete the program, or are revoked from it, they would face trial on all pending charges. A person does not admit guilt in entering the program.

All were placed for a year, unless otherwise noted.

Derek Andrade, 46, of South Dartmouth, Massachusetts, was arrested on Sept. 1, 2018, by state police at Fern Ridge along South Lake Dive in Kidder Township. A test revealed a 0.09 BAC.

He was placed for six months and assessed $450 for the cost of the program.

Yessenia Estenes, 41, of Hazleton, was arrested on Aug. 9, 2018, along Plane Street by Weatherly police. A test revealed the presence of a controlled substance. She was also charged with endangering the welfare of a child as she had a 15-year-old juvenile in the vehicle at the time of the stop.

She was assessed $600, and her license was suspended for 60 days.

Mark Robert Evans, 36, of Lehighton, was arrested on Aug. 24, 2018, by Lehighton police along the Sgt. Stanley Hoffman Boulevard. A test revealed the presence of a controlled substance.

He was assessed $600, and his license suspended for 60 days.

Scott Michael Hart, 46, of Bridgewater, New Jersey, was arrested on Sept. 15, 2018, along Route 903 in Kidder Township by state police at Fern Ridge. A test revealed the presence of a controlled substance.

He was assessed $600, and his license suspended for 60 days.

Bryan Wilson Lyda, 40, of Lansford, was arrested on March 16, 2018, by state police at Lehighton along Route 443 in Mahoning Township. He refused a test.

He was assessed $650, and his license was suspended for 60 days.

Michael P. McLaughlin, 53, of Nesquehoning, was arrested on July 15, 2018, by Nesquehoning police in the area of Catawissa Street and Cemetery Road. A test revealed a 0.28 BAC.

He was assessed $550 and his license was suspended for 60 days.

Chris Rosario, 38, of Reading, was arrested on July 1, 2018, along Main Street by Weatherly police. A test revealed the presence of a controlled substance.

He was assessed $600, and his license was suspended for 60 days.

Cassidy Ryan, 20, of Lansford, was arrested on Dec. 31, 2017, by Summit Hill police along Route 209. A test revealed a 0.04 BAC.

She was assessed $450, and her license was suspended for 90 days.

Francesca Steele Trovato, 40, of Blakeslee, was arrested on June 10, 2017, by state police at Fern Ridge along Route 903 in Kidder Township. A test revealed a 0.14 BAC.

She was assessed $500, and her license was suspended for 30 days.

Jorge Alexis Zambrana-Sierra, 27, of Fogelsville, was arrested on Sept. 17, 2018, by Lehighton police along South First Street. A test revealed the presence of a controlled substance.

He was assessed $600, and his license was suspended for 60 days.

Each defendant must also pay court costs of about $1,000, a $50 per month supervision fee and follow any recommendation of their drug and alcohol evaluation.

Retail theft

Brenda L. Bennett, 58, of Tamaqua, was placed for six months on a retail theft charge. She was arrested on Aug. 11, 2018, by Mahoning Township police at the Walmart store.

She was assessed $450, ordered to get a drug and alcohol evaluation and follow any recommendation for treatment, pay court costs of about $1,000 and pay a $50 per month supervision fee while in the program.
