Carbon County court – DUI
Five people who previously pleaded to driving under the influence and related charges were sentenced last Friday in Carbon County court.
President Judge Roger N. Nanovic II sentenced the following:
Nelson Geigel-Cuenca, 24, of Kresgeville, was sentenced on 2 DUI cases.
In the first case he was sentenced to serve 72 hours to six months in jail, pay a $1,000 fine, license suspended for a year and zero tolerance for drug or alcohol use. On the second count he was sentenced to serve six months to five years, a fine of $2,500 and a license suspension of 18 months.
He also pleaded to one count of accidents involving damage to unattended vehicle and possession of drug paraphernalia. In both cases he was placed on probation for a year. All the sentences run concurrent to each other.
On a charge of driving under suspension charge he was fined $200 and costs.
All the incidents occurred in Palmerton.
The first arrest occurred on Feb. 19, 2017, along Delaware Avenue and the second on March 12, 2017, along Avenue A, after he was involved in a hit-and-run crash leading to the accidents count. In the second case, Geigel-Cuenca was found a distance from the crash scene. While taking him into custody, officers found drug paraphernalia on him and also learned his license was under suspension.
Geigel-Cuenca is currently an inmate in the Monroe County prison on other charges.
Dylan Ross Furry, 22, of Jenson Beach, Florida, previously pleaded to two counts of DUI and one count of possession of drug paraphernalia.
On the first count he was sentenced to serve 72 hours to six months in jail, a fine of $1,000 and a one-year license suspension. He was given credit for three days already served and paroled.
He will also spent six months, less three days, in the county’s Intermediate Punishment Program — house arrest.
On the second count he was sentenced to serve 30 days in jail followed by five years, less 30 days, in the IPP with the first 60 days on electronic monitoring. He was also ordered to pay a fine of $1,500 and his license was suspended for 18 months. He was given credit for 30 days spent in a drug rehab program and paroled.
On the paraphernalia count he was placed on probation for a year, concurrent with the other charges.
He was arrested on the first count on Feb. 24, 2017, along Route 443 by Lehighton police. The second arrest was on May 7, 2017, along Delaware Avenue by Palmerton police. Drug paraphernalia was found in that stop. In both stops a test revealed the presence of a controlled substance.
Robert Michael Stelling, 46, of New Tripoli, and formerly of Lehighton, previously pleaded to three DUI counts.
On the first count he was sentenced to six months probation and a fine of $300. On the second count he was sentenced to serve 30 days to six months in jail, a fine of $2,500 and one-year license suspension. On the third count he was sentenced to serve six months to five years in jail, a fine of $4,000 and an 18-month license suspension. The jail terms run concurrently.
He was arrested on the first count on Sept. 10, 2016, along Forest Inn Road in Lower Towamensing Township by state police at Lehighton. A test revealed a 0.10 BAC. The second arrest occurred on Nov. 20, 2016, also on Forest Inn Road by state police. A test revealed a 0.14 BAC. The third arrest occurred on March 25, 2017, along Stony Ridge Road in Lower Towamensing Township by state police. A test revealed a 0.10 BAC.
He will serve the sentence on consecutive three-day weekends beginning Nov. 2 at 9 a.m.
Jared Aaron Hauser, 29, of Weissport, previously entered pleas in three pending cases.
On a DUI count he was sentenced to serve 30 days to six months in jail, a fine of $1,000, one-year license suspension and zero tolerance for drug or alcohol use. He was given credit for 30 days already served and paroled.
On a charge of possession of a controlled substance — heroin — he was sentenced to serve 70 days to one year in jail, consecutive to the DUI charge. He was given credit for 70 days already served and paroled.
On a summary offense of depositing waste on a roadway he was fined $300 and costs.
He was arrested for the DUI on Jan. 10, 2016, filed by state police at Lehighton following a vehicle stop along Bridge Street in Weissport. A test revealed the presence of a controlled substance.
He was arrested on the possession of a controlled substance charge on Aug. 23, 2016, along Bridge Street in Weissport filed by state police. In that case a charge of DUI was dropped. The summary offense of depositing waste on a roadway occurred at the Aug. 23 arrest.
Daniel Scott Leslie Jr., 25, of Palmerton, was sentenced to serve 72 hours to six months in jail, a fine of $1,000 and a one-year license suspension.
He was arrested on June 23, 2017, by Palmerton police along Delaware Avenue.
He was given credit for 69 days already served on the charge and paroled.
Each defendant must also pay court costs of about $1,000, a $50 monthly supervision fee while on parole or probation and follow any recommendation of their drug and alcohol evaluation.
