Carbon County court – DUI
A total of 26 defendants entered guilty pleas on Tuesday afternoon to driving under the influence charges in Carbon County court.
Judge Steven R. Serfass conducted the DUI court session and accepted pleas from the following:
Andrew Arnold, 30, of Brodheadsville, was arrested on May 28, 2018, by Palmerton police along Delaware Avenue. A test revealed the presence of a controlled substance.
Sentencing was deferred and the court ordered the adult probation office to prepare a presentence investigation report.
John Palmer Cleland Jr., 52, of Nesquehoning, was arrested on Nov. 12, 2018, by Franklin Township police along Long Run Road. A test revealed a 0.18 BAC.
He was sentenced to serve 30 days to six months in jail, a fine of $750, one-year license suspension and render 25 hours of community service.
He will begin the jail term at 7 p.m. on May 3 and serve it on consecutive two-day weekends.
Jessica Marie Dementri, 25, of Jim Thorpe, pleaded to DUI and possession of a controlled substance for a Nov. 22, 2018, incident along Route 903 in Penn Forest Township filed by state police at Fern Ridge; and possession of a controlled substance for an incident on Oct. 23, 2018, also along Route 903 at Stony Creek Road, in Penn Forest Township, filed by state police at Fern Ridge.
Sentencing was deferred so she can apply for placement in the Intermediate Punishment Program, house arrest.
Michael Christopher Devitt, 30, of Albrightsville, was arrested on Jan. 17 along Route 903 in Kidder Township by state police at Fern Ridge. A test revealed a 0.10 BAC.
A first offense, he was placed on probation for six months and ordered to pay a fine of $300 and render 25 hours of community service.
Nieko Eric Evans, 39, of Lansford, was arrested on Dec. 9, 2018, along Abbott Street by Lansford police. He refused a test.
Sentencing was deferred so Evans can obtain a drug and alcohol evaluation.
Trevor Austin Evans, 26, of Lansford, was arrested on Sept. 20, 2018, by state police at Lehighton along Walnut Street in Lansford. A test revealed the presence of a controlled substance.
Sentencing was deferred so he can obtain a drug and alcohol evaluation and also apply for placement in the IPP.
Timothy Foley, 24, of Albrightsville, was arrested on Sept. 16, 2018, by state police at Fern Ridge along Route 903 in Penn Forest Township. A test revealed a 0.11 BAC.
Sentencing was deferred so he can obtain a drug and alcohol evaluation.
Randy Allen Gildner, 65, of Lehighton, was arrested on Dec. 13, 2018, by state police at Lehighton along Route 248 at Bowmanstown. A test revealed a 0.28 BAC.
Sentencing was deferred.
Amy J. Hawk, 44, of Weissport, was arrested on March 26, 2016, along Route 248 at Bowmanstown by state police at Lehighton. A test revealed the presence of a controlled substance. She was previously placed in the county’s Accelerated Rehabilitation Disposition probation program but was revoked from it.
Serfass sentenced her to serve 72 hours to six months in jail, a fine of $1,000, one-year license suspension and render 25 hours of community service. On a driving under suspension count she was fined $500 and costs.
She was given credit for time spent in an inpatient rehab program and paroled.
William Frederick Jones, 61, of Effort, was arrested on June 2, 2018, by state police at Fern Ridge along Route 903 in Kidder Township. A test revealed a 0.18 BAC.
Sentencing was deferred so Jones can apply for placement in the IPP.
Collin J. Kirkpatrick, 57, of Andreas, was arrested on Nov. 17, 2018, by Lehighton police along Route 443. A test revealed a 0.17 BAC.
He was placed on probation for six months and ordered to pay a fine of $300 and render 25 hours of community service.
Jeffrey R. Kistler, 35, of Andreas, was arrested on Jan. 20, 2017, by Mahoning Township police along Route 443. He refused a test.
Sentencing was deferred so he can get a drug and alcohol evaluation.
Shawn A. Kulp, 45, of Telford, Montgomery County, was arrested on July 24, 2018, along Route 903 by Kidder Township police. A test revealed a 0.30 BAC.
He was placed on probation for six months and ordered to pay a fine of $300 and render 25 hours of community service.
Jesse Lee Leiby, 37, of Lehighton, was arrested on May 22, 2018, by Mahoning Township police along Mauch Chunk Street. He refused a test.
Sentencing was deferred so he can obtain a drug and alcohol evaluation.
Aaron Gregory Long, 39, of Palmerton, was arrested on Dec. 22, 2017, by state police at Lehighton along Forest Inn Road in Towamensing Township. A test revealed a 0.30 BAC. He was previously placed in the ARD program but was revoked from it.
He was sentenced to serve five days to six months in jail, a fine of $500, one-year license suspension and render 25 hours of community service.
He will begin the jail term at 7 p.m. on May 10 and serve it on consecutive weekends of two days, two days and one day.
Sean Maiden, 43, of Jim Thorpe, was arrested on July 6, 2018, by Lehighton police along West Alley. A test revealed the presence of a controlled substance. He also pleaded to one count of possession of a controlled substance for an incident along South East Alley at Iron Street, Lehighton, also on July 6. Methamphetamine was the drug noted in the police report.
Sentencing was deferred and a presentence investigation report by the adult probation office was ordered.
Lisa Neff, 55, of Lehighton, was arrested on May 6, 2018, by Mahoning Township police along Hemlock Drive after being involved in a crash. A test revealed the presence of a controlled substance.
Sentencing was deferred so she can apply for placement in the IPP.
Paul Niedzialek, 27, of Nesquehoning, was arrested on Oct. 20, 2017, along Route 209 by Nesquehoning police. A test revealed a 0.08 BAC.
Sentencing was deferred so he can obtain a drug and alcohol evaluation.
Kenneth Joseph Pahler, 47, of West Hazleton, was arrested on April 30, 2017, by Weatherly police along Wilbur Street. A test revealed a 0.19 BAC.

Tracy Anne Rambo, 52, of Lehighton, was arrested on Nov. 18, 2018, by state police at Lehighton along Lizard Creek Road in East Penn Township after being involved in a crash. A test revealed a 0.28 BAC.
She was placed on probation for six months and ordered to pay a fine of $300 and render 25 hours of community service.

Keith T. Schlicher, 51, of Slatington, was arrested on March 24, 2018, along Mauch Chunk Street by Palmerton police. A test revealed the presence of a controlled substance.

Buddy Schum, 31, of Philadelphia, was arrested on Aug. 29, 2017, along Abbott Street by Lansford police. A test revealed the presence of a controlled substance.

David Robert Snyder, 64, of Palmerton, was arrested on July 27, 2018, by state police at Lehighton along Route 248 in Lower Towamensing Township. A test revealed a 0.20 BAC.

Charles Nicholas Veet, 47, of Kelayres, was arrested on Feb. 11, 2017, by state police at Hazleton along Market Street in Banks Township. A test revealed a 0.20 BAC.

Jerome M. Yanchick Jr., 34, of Kunkletown, was arrested on April 7, 2017, by Kidder Township police along Route 903. A test revealed the presence of a controlled substance.
Sentencing was deferred so he can obtain a drug and alcohol evaluation and also apply for placement in the IPP.
All defendants who were sentenced must also pay court costs of about $1,000, a $50 per month supervision fee while on probation or parole and follow any recommendation of their drug and alcohol evaluation.
