Carbon County court — ARD
Eight first-time offenders in the criminal justice system were placed in Carbon County’s Accelerated Rehabilitation Disposition probation program on Monday by Judge Joseph J. Matika.
If a person successfully completes all conditions of the program, their record will be wiped clean. However, if they fail to complete it, or are revoked from it, then they would face trial on all pending charges. A person does not admit guilt in entering the program.
All were placed for a year, unless otherwise noted.
Troy Bollinger, 50, of Lehighton, was placed on a charge of terroristic threats and related counts. He was arrested on Feb. 16, 2019, by state police at Lehighton for an incident in Franklin Township. He allegedly threatened another individual.
He was assessed $650 for the cost of the program and ordered to render 50 hours of community service, attend and successfully complete an anger management course and have no contact with the victim.
Tamara A. Fenstermacher, 25, of Tamaqua, was placed on a charge of possession of a controlled substance — marijuana.
She was arrested on Sept. 13, 2019, by Franklin Township police at Main Road and Canal Street.
She was assessed $450 and ordered to get a drug and alcohol evaluation and follow any recommendation for treatment and render 50 hours of community service.
Amy Jo Graver, 44, of Lehighton, was placed on a charge of possession of drug paraphernalia.
She was arrested on Aug. 13, 2019, Franklin Township police at a residence along Main Road during the execution of a search warrant.
She was assessed $650 and ordered to get a drug and alcohol evaluation and render 50 hours of community service.
Yvonne Cecelia Hineline, 22, of Gilbert, was placed for 18 months on a charge of a felony count of deal in procuring unlawful act/intent to promote a crime. She was charged, along with a 17-year-old female juvenile, with cashing a payroll check twice.
She was assessed $650 and ordered to render 75 hours of community service, make restitution of $1,023.50 (which has already been paid), and have no contact with the victim.
Patrick Thomas Lawler, 20, of Lehighton, was placed for six months on a charge of possession of a small amount of marijuana.
He was arrested on Sept. 14, 2019, by state police at Lehighton along Mill Run Road in Franklin Township.
He was assessed $650 and ordered to render 25 hours of community service.
Felisha Xaviera Veron, 21, of Palmerton, was placed for six months on a charge of possession of drug paraphernalia.
She was arrested on Aug. 31, 2019, by state police at Lehighton along Delaware Avenue at Seventh Street.
She was assessed $450 and ordered to render 25 hours of community service.
John W. Walton III, 43, of Weatherly, was placed on a charge of recklessly endangering another person, DUI and endangering the welfare of a child. He was originally charged with a total of nine counts.
He was arrested on Aug. 5, 2019, by Weatherly police along Eurana Avenue following a vehicle stop. Police said there were two juveniles in the vehicle at the time, ages 15 and 16.
He was assessed $650 and ordered to render 50 hours of community service.
Andrew J. White, 52, of Palmerton, was placed on charges of terroristic threats and simple assault.
He was arrested on Aug. 1, 2019, by state police at Lehighton, for an incident at a residence along Ore Street in Bowmanstown. Troopers were dispatched to a report of a neighbors dispute in which White allegedly made threats against two others.
He was assessed $450 and ordered to render 50 hours of community service, make restitution of $680 and have no contact with the victims.
Each defendant must also pay court costs of about $1,000 and a $50 per month supervision fee while in the program.
