Carbon County court — DUI

Three defendants, who previously pleaded to driving under the influence charges, were sentenced on Thursday morning in Carbon County court.

Judge Steven R. Serfass sentenced the following:

Bruce Meixsell, 26, of Palmerton, entered a plea to another count of DUI before his sentencing on his first count of DUI. The second arrest occurred on Aug. 15, 2017, along Route 248 at Bowmanstown by state police at Lehighton.

Troopers stopped him because of an active warrant for his arrest and found him under the influence of a controlled substance. In exchange for the plea, charges of possession of a controlled substance and possession of drug paraphernalia were dropped.

The second arrest occurred on March 20, 2017, by Lehighton police. In that case the commonwealth dropped a felony count of possession with intent to deliver a controlled substance and three misdemeanor drug charges.

On the first count, Serfass sentenced him to serve 72 hours to six months in jail, pay a fine of $1,000 and one-year license suspension. He was given credit for 90 days spent in an inpatient rehabilitation program and jail and paroled.

On the second DUI he was sentenced to time-served, 95 days, to 60 months, a fine of $1,500 and another license suspension of 18 months. He must also render a total of 100 hours of community service.

On a charge of possession of drug paraphernalia he was placed on probation for six months. All the sentences run concurrent to each other.

Meixsell is currently an inmate in the county prison on a pending parole revocation petition filed by the adult probation office.

Kane Gordon Shive, 23, of Pen Argyl, was sentenced to serve 30 days in jail followed by 59 months in the county’s Intermediate Punishment Program with the first 60 days on electronic monitoring. He must also pay a fine of $1,500, license suspended for 18 months and render 100 hours of community service.

He arrested on April 21, 2018, by Lehighton police along First Street. A test revealed the presence of a controlled substance.

He will begin the jail term on March 1 at 9 a.m. and serve it on consecutive two-day weekends.

Jeremiah Alan Veanus, 23, of Walnutport, was sentenced to serve 30 days to six months in jail, a fine of $500, one-year license suspension and render 25 hours of community service. He was given credit for 33 days already spent in an inpatient rehab program and jail and paroled.

He arrested on July 8, 2017, at the Weissport Canal by state police at Lehighton, after being involved in a crash. A test revealed a 0.24 BAC.

Each defendant must also pay court costs of about $1,000, a $50 per month supervision fee while on parole and follow any recommendation of their drug and alcohol evaluation.
