Carbon County court — guilty pleas

A Monroe County man was sentenced in Carbon County court on Thursday to a state prison term after entering a guilty plea to a theft charge.

He was one of four defendants in pending criminal cases to enter a guilty plea before President Judge Roger N. Nanovic II.

Credit card theft

David Cody Shanahan, 55, of Kresgeville, admitted taking a credit card belonging to his mother from her mailbox and then using it to make purchases.

The charges were filed for an incident on Oct. 13, 2017, in Towamensing Township filed by state police at Lehighton.

Nanovic noted that Shanahan, who is currently an inmate in the state correctional institution at Waymart, Wayne County, has a criminal record covering “about a quarter century.”

Nanovic sentenced him to serve one to two years in a state prison consecutive to a state parole term he is currently serving. He was also ordered to make restitution of $407.67 to his mother.

Other pleas

David T. Pasternak, 48, of Lehighton, pleaded to one count of persistent disorderly conduct, which was an added charge to the original complaint. A charge of indecent assault was dropped in a plea bargain with the district attorney’s office.

He was charged by Franklin Township police for an incident on Dec. 20, 2017, at his residence along Main Road. A female accused him of grabbing her breasts.

Sentencing was deferred.

Tammy Jean Heiserman, 42, of Palmerton, pleaded to one count of criminal conspiracy — receiving stolen property. She was charged by Palmerton police for her part in the theft of an ATM card of a borough resident and then using it to make a total of 29 transactions, which resulted in a monetary loss of $5,141.17. There are two co-defendants in the case.

Heiserman is currently an inmate in the county prison.

Sentencing was continued because of a question concerning the amount of jail time credit Heiserman is entitled to on the charge.

Shaka Diamaye, 34, of Hudson, Plains Township, Luzerne County, pleaded to one count of disorderly conduct as a summary offense with a charge of theft of services dropped in a plea bargain. He was charged by Franklin Township police with paying for a room at the Country Inn & Suites, Route 209, on June 20, 2015, with a fraudulent credit card, and when confronted, never paid the bill. He has since paid the bill for the room.

Nanovic imposed a fine of $300 and costs.

Each defendant sentenced must also pay court costs of about $1,000 and a $50 per month supervision fee while on parole or probation.
