Carbon County court

A Lehighton woman admitted in Carbon County court on Monday to stealing the credit card of a relative and using it to make various purchases.

She was one of five defendants in pending criminal cases to enter a guilty plea before Judge Steven R. Serfass.

Lehighton incident

Heavenly Radea Dailey, 20, pleaded guilty to one count of receiving stolen property filed by Lehighton police. She admitted stealing the credit card of a relative and then using it at various locations in and around Carbon County running up a bill of over $700. In exchange for the plea the district attorney’s office dropped a count of access device fraud, a felony, for a misdemeanor 3 count.

Dailey admitted being with the victim at the Walmart store in Mahoning Township on Sept. 17, 2017, and taking the card from the victim’s purse and then using it. The victim did not realize the card was missing until a few days later.

Dailey admitted to drug problems at the time of the incident.

Serfass placed her on probation for a year and ordered her to get a drug and alcohol evaluation and follow any recommendation for treatment, zero tolerance for drug or alcohol use, make restitution of $728.04 to the credit card company and render 50 hours of community service.

Damages vehicle

Joseph Lindermuth, 19, of Jim Thorpe, pleaded to one count of criminal mischief. He admitted damaging the vehicle of a Jim Thorpe woman on April 11, 2018, along Oak Street. The police report indicates the victim’s daughter was at Lindermuth’s home when she decided to leave and he didn’t want her to leave. When she got into the vehicle, Lindermuth jumped on its hood and did other damages to it.

Serfass placed him on probation for 24 months and ordered he make restitution of $3,133 and render 100 hours of community service. Lindermuth is currently an inmate in the county prison.

DUI cases

The following defendants entered guilty pleas to driving under the influence charges.

Joshua Michael Bertalan, 24, of Bowmanstown, was arrested on May 25, 2016, along Bridge Street by Lehighton police. A test revealed the presence of a controlled substance.

Sentencing was deferred so Bertalan can obtain a drug and alcohol evaluation.

Larry Braker Jr., 48, of Walnutport, was arrested on April 11, 2018, along Third Street by Palmerton police. A test revealed the presence of a controlled substance.

Sentencing was deferred to Braker can obtain a drug and alcohol evaluation.

Jorge Angel Vega-Martinez, 25, of Allentown, was arrested on April 14, 2016, along Mauch Chunk Street by state police at Lehighton. A test revealed the presence of a controlled substance.

Sentencing was deferred so Vega-Martinez can obtain a comprehensive drug and alcohol evaluation.

Each defendant who was sentenced must also pay court costs of about $1,000 and pay a $50 per month supervision fee while on probation or parole.
