Fall suit
Christina Pammer, 1325 North St., Jim Thorpe, filed an action against the Carbon County Area Vocational-Technical School Authority and the vocational-technical foundation, both of 150 13th St., Jim Thorpe; the borough of Jim Thorpe, 101 E. 10th St., Jim Thorpe, and the Pennsylvania Department of Transportation, 400 North St., Harrisburg.
The suit states on Oct. 31, 2016, the plaintiff was jogging northbound on North Street, near the intersection with 13th St., toward her home, and adjacent to a parcel of land at the northwest corner of the intersection owned by the defendant vocational-technical school. The lot consists primarily of landscaping and a large digital sign for the career institute. The property is narrow and does not contain sidewalks or pedestrian paths, the suit states.
The plaintiff, the suit alleges, had observed pedestrians traveling northbound on North Street, frequently walk and/or jog into the grass section along the eastern edge to avoid vehicle traffic and believed the property to be open to the public.
On the date stated, the suit alleges, the plaintiff was jogging northbound and entered into the grass area and was caused to fall to the ground after her foot struck a metal and/or concrete object protruding 2 to 3 inches from the ground. It is believed the object is a remnant of a former street sign. The suit alleges this created a unreasonably dangerous defect of the property. Due to the fall, the plaintiff suffered injuries detailed in the suit.
Negligence is alleged against the defendants and sought are damages in excess of $50,000 against each defendant.
