Credit defaults

The following actions were filed by credit card companies, or their collection agencies, for alleged defaults on credit card/loan accounts

Portfolio Recovery Associates, Norfolk, Virginia, filed nine actions as follows: Michele Mitchem, 236 W. Columbus Ave., Nesquehoning, seeking $4,749.66; Troy T. Stamets, 67 Sandlewood Road, Jim Thorpe, seeking $1,862.95; Amar Jahic, 94 Buckhill Road, Albrightsville, seeking $2,872.35; John Rivera, 142 Old Stage Road, Albrightsville, seeking $2,356.22; Richard Giordano, 237 Sixth St., Weatherly, seeking $3,587.56; George V. Jackson, 24 Hawthorne Drive, Jim Thorpe, seeking $9,611.09; Tanya L. McLean, 1366R Twin Crest Drive, Lehighton, seeking $2,402.08; Alan A. Raab, 168 W. Bowmans Road, Lehighton, seeking $37,244.10; and David V. Biever, 8 Pawnee Trail, Albrightsville, seeking $4,716.56.

Mortgage foreclosures

The following actions were filed as mortgage foreclosures for alleged defaults on loans.

MTGLQ Investors, LP, c/o 9990 Richmond Ave., Houston, Texas, filed against Melissa A. Watto, 326 W. Catawissa St., Nesquehoning, over property at that address. Sought is $62,929.15 and continuing interest.

MTGLQ Investors filed against Russell C. and Windy L. Smith, 212 White St., Weissport, over property at that address. Sought is $37,505.24 and continuing interest.

Dog dispute

Donna and Greg Homiller, 29 Quail Run, Lake Harmony, filed a civil action against Shelly J. Kalins-Lutz and Jeff Lutz, 200 Wolf Hollow Road, Lake Harmony.

The suit states on Dec. 9, 2016, the defendants permitted their pit bull dog to leave their property and cross over onto the plaintiffs’ property where it chased the plaintiff’s dog and allegedly viciously attacked their small dog inside the plaintiffs’ home.

Donna Homiller attempted to remove the defendants’ dog from her home, the suit further alleges, when the pit bull dog turned on her, biting her on the right hand. She continued to attempt to get the pit bull dog out of her home by striking it with a baking sheet. As a result of the injuries sustained in the attack, the plaintiffs dog had to be put down, the suit states.

The suit also refers to other incidents with the defendants’ dogs that occurred at times and dates stated in the suit. The suit also claims Greg Homiller had told the defendants to keep their dog off his property sometime before the incidents.

The two-count suit seeks damages in excess of $50,000 on each count.

Prothonotary’s report

A total of case 308 were started in November in the office of Carbon County Prothonotary Joann M. Behrens, according to a monthly statistical report released by the officeholder. A breakdown of cases is as follows:

Assessment appeals, 3; civil actions, 33; custody complaints, 17; complaints to modify custody, 10; district justice appeals, 3; divorce complaints, 14; complaint in ejectment, 1; mortgage foreclosure complaints, 8; protection from abuse petitions, 22; protection from abuse from sexually violent individual petition, 1; quiet title actions, 5; judgments, 166; miscellaneous case, 1; paternity suit, 1; stipulations/waivers of liens, 3; and writs of executions, 20. The office also processed 62 applications for U.S. passports and assisted the public in 15 passport renewal applications.

Behrens’ financial report for November shows $31,425.51 was generated as follows: prothonotary’s fees, $24,615.28; interest income, $3.73; custody/divorce fees, $2,926.50; PFA surcharge, sheriff, $25; PFA surcharge, courts, $25; data processing fees, $3,495; stenographer fees, $335; and remote access fees, $7,400.

The prothonotary also remitted $3,222.34 to the Commonwealth of Pennsylvania, Department of Revenue, representing state fees collected locally, and $32 to the Administrative Offices of the Pennsylvania Courts, this being surcharges on new custody cases in accordance with Act 119 of 1996. Another $1,050 was deposited in the Prothonotary’s Automation Fund for future use in automating the office.
