Prothonotary’s report

A total of 252 cases were started in January in the office of Carbon County Prothonotary Joann M. Behrens, according to a monthly statistical report released by the officeholder. A breakdown of cases is as follows:

Civil actions, 26; custody complaints, 20; complaints to modify custody, 21; district justice appeals, 3; divorce complaints, 13; complaint in ejectment, 1; license appeals, 3; mortgage foreclosure complaints, 15; protection from abuse petitions, 19; quiet title action, 1; auditor/financial report, 1; court appointments, 6; judgments, 93; miscellaneous cases, 5; stipulations/waivers of liens, 3; and writs of executions, 22. The office staff also processed 72 passport applications and assisted with the processing of 25 passport renewal applications.

Behrens’ financial report for January shows $31,431.23 was generated as follows: prothonotary’s fees, $26,796.59; interest income, $2.14; custody/divorce fees, $585; PFA Surcharge, Sheriff,$40; PFA Surcharge, Courts, $25; data processing fees, $3,377.50; stenographer fees, $605; and remote access fees, $3,300.

The prothonotary also remitted $4,176.30 to the Commonwealth of Pennsylvania, Department of Revenue, representing state fees collected locally, and $81.60 to the Administrative Offices of the Pennsylvania Courts, this being surcharges on new custody cases in accordance with Act 119 of 1996. Another $999.81 was deposited in the Prothonotary’s Automation Fund for future use in automating the office.

Loan defaults

Two actions were filed by companies claiming the defendants default on auto loan agreements.

New City Funding Corporation, 146 S. Liberty Drive, Stony Point, New York, filed against Jennifer R. Moran, 341 W. Kline Ave., Lansford, seeking $6,006.87 plus interest, costs and fees.

Ally Financial Inc., 500 Woodward Ave., Detroit, Michigan, filed against Justin P. Hinger, 27 W. Second St., Jim Thorpe, seeking $18,772.18 plus interest, costs and fees.

Credit defaults

The following actions were filed by credit card companies, or their collection agencies, for alleged defaults on credit card/loan accounts.

Cavalry SPV I, Mount Laurel, New Jersey, filed to actions as follows: Jamie Raso, 56 Sassafras Road, Albrightsville, seeking $1,533.45; and Todd Woodward, 6 First Lane, Jim Thorpe, seeking $5,517.72.

Portfolio Recovery Associates, Norfolk, Virginia, filed against Jenna L. Reith, 2001 Route 903, Jim Thorpe, seeking $9,014.31.

Barclays Bank Delaware, Wilmington, Delaware, filed against John D. Shemansik, 125 E. White St., Summit Hill, seeking $2,605.57.

Unifund CCR, Blue Ash, Ohio, filed against George V. Jackson, 24 Hawthorne Drive, Jim Thorpe, seeking $5,189.40.

Mortgage foreclosures

The following actions were filed as mortgage foreclosures for alleged defaults on loans.

Wells Fargo Bank, c/o 3476 Stateview Blvd., Fort Mill, South Carolina, filed an action against Mark Kudela, 271 Bankway, Lehighton, in his capacity as heir of Viera Kudela, aka Viera Alice Theresa Kudela, over property at 271 Bankway. Sought is $16,928.04 and continuing interest.

Wells Fargo Bank filed an action against Connie and Kenneth Dise, 1301 N. 24th St., Allentown, and Double D Real Estate LLC, 1636 N. Cedar Crest Blvd., Allentown, over property at 339 W. Patterson St., Lansford. Sought is $43,890.92 and continuing interest.

Wells Fargo Bank filed an action against Joseph and Elizabeth Toth, 1882 Dinkey Road, Lehighton, over property at that address. Sought is $54,490.46 and continuing interest.

Nationstar Mortgage, c/o 3600 Horizon Drive, King of Prussia, filed an action against Bethanne Grace Hauser, 438 White St., Lehighton, over property at 20 Spring Hill Road, Lehighton. Sought is $112,633.31 and continuing interest.

U.S. Bank National Association, c/o 3476 Stateview Blvd., Fort Mill, South Carolina, filed an action against Jennifer L. Mattei, 148 E. Hazard St., Summit Hill, over property at that address. Sought is $42,258.35 and continuing interest.

Auto crash suit

Ellen Best, 198 Coal St., Nesquehoning, filed a civil action against William Leroy Hoffman, 727 N. First St., Lehighton, over an automobile accident.

The suit states on Dec. 3, 2017, the plaintiff was a passenger in a vehicle operated by Gustavo Rosario Jr., on Route 209 in Mahoning Township, when the defendant allegedly drove his vehicle from a lot onto 209 and into Rosario’s vehicle. The suit states the plaintiff suffered injuries in the crash which are detailed in the suit.

Negligence and carelessness is alleged against the defendant and sought are damages in “excess of the jurisdictional” amount regarding arbitration.
