Prothonotary’s report

A total of 465 cases started in April in the office of Carbon County Prothonotary Joann M. Behrens, according to a monthly statistical report released by the officeholder. A breakdown of cases is as follows:

Civil actions, 32; custody complaints, 16; complaints to modify custody, 11; district justice appeals, 5; divorce complaints, 16; complaints in ejectment, 5; license appeals, 2; mortgage foreclosure complaints, 15; complaints in partition, 2; name change petitions, 4; protection from abuse petitions, 26; auditor/financial report, 1; judgments, 296; miscellaneous case, 1; stipulations/waivers of liens, 6; and writs of executions, 27. The office also processed 129 applications for U.S. passports and rendered assistance to the public with 75 passport renewal applications.

Behrens’ financial report for April shows $34,174.92 was generated as follows: prothonotary’s fees, $28,556.34; interest income, $3.54; custody/divorce fees, $1,200; PFA Surcharge, Sheriff; $80; PFA Surcharge, Courts; $80; data processing; $3,669.04; stenographer fees, $586; and remote access fees, $1,800.

The prothonotary also remitted $4,132.28 to the Commonwealth of Pennsylvania, Department of Revenue, representing state fees collected locally, and $81.60 to the Administrative Offices of the Pennsylvania Courts, this being surcharges on new custody cases in accordance with Act 119 of 1996. Another $1,167.67 was deposited in the Prothonotary’s Automation Fund for future use in automating the office.

Credit defaults

The following actions were filed by credit card companies, or their collection agencies, alleging defaults on credit card/loan accounts.

Portfolio Recovery Associates, Norfolk, Virginia, filed the following actions: Bobby and Tammy Kolek, 81 Jamestown Drive, Lehighton, seeking $2,161.20; and Matthew W. Searfoss, 713 North St., Jim Thorpe, seeking $1,944.64.

LVNV Funding, Horsham, filed the following actions: Tanya Hosier, 1366R Twin Crest Drive, Lehighton, seeking $1,778.69; and Kelly Gillespie, 624 Lehigh St., Lehighton, seeking $1,021.03.

Midland Funding, Philadelphia, filed against Ellen Sowers, 98 Lehigh Ave., Palmerton, seeking $1,246.95.

Mortgage foreclosures

The following actions were filed as mortgage foreclosures for alleged defaults on loans.

U.S. Bank National Association, c/o 1 Mortgage Way, Mount Laurel, New Jersey, filed against Douglas M. and Marlo L. Wargo, 146 Lafayette Ave., Palmerton, over property at that address. Sought is $76,118.39 and continuing interest.

Citizens Bank, c/o 10561 Telegraph Road, Glen Allen, Virginia, filed against Arvilla Bodemer, 130 Mansi Drive, Albrightsville, seeking $44,693.82 and continuing interest.

Lakeview Loan Servicing LLC, c/o 4425 Ponce De Leon Blvd., Coral Gables, Florida, filed against Lorene Bittenbender, Christopher Miller and Jonmarie Miller, all of 714 Mahoning St., Lehighton, over property at that address. Sought is $123,102.77 and continuing interest.

Pennymac Loan Services, c/o 3043 Towngate Road, Westlake Village, California, filed against Matthew W. Searfoss, 713 North St., Jim Thorpe, over property at that address. Sought is $93,319.87 and continuing interest.
