Officer, borough sued
A Nesquehoning police officer and the borough of Nesquehoning have been named defendants in a lawsuit seeking damages for injuries sustained in an accident.
Jonathan Fernandez, of 689 Hayes St., Hazleton, filed the action against officer Derek Edward Marouchoc and the borough.
According to the suit on Jan. 19 the plaintiff was a pedestrian walking southbound on the berm of Route 93, also known as Hunter Street, in Nesquehoning, when suddenly he was struck by the passenger side mirror of a 2015 Ford interceptor police vehicle operated by Marouchoc and owned by the borough. The suit alleges the vehicle drifted off the road and onto the berm in striking the plaintiff.
The impact, the suit alleges, was “so forceful and violent” it caused Fernandez to suffer severe injuries detailed in the suit.
Negligence is alleged against the defendants and sought are damages in an amount in excess of $50,000 plus costs.
