Jim Thorpe man admits to assault charge
A Jim Thorpe man admitted to a charge of simple assault on Monday in Carbon County court for an incident that occurred while he was awaiting court proceedings on charges stemming from a fatal crash.
Tegan Lestat Kane, 22, was sentenced to time-served (nine days) to one day less 24 months on the charge by Judge Steven R. Serfass.
Kane was charged for an incident on Nov. 25, 2017, at a residence along Packer Hill in Jim Thorpe. Kane and others went to a “house party” that was being held at the home, uninvited, according to the police report. At the home, Kane was asked to leave and got into an argument with another male. Police said Kane struck the victim over the head with a bottle, causing injuries that required medical treatment.
Kane’s attorney, Brett J. Regel, said during a preliminary hearing held in the matter the witnesses stated they did not see a bottle being used in the altercation.
In a plea bargain with the district attorney’s office, charges of aggravated assault and recklessly endangering another person were dropped.
At the time of the incident, Kane was on bail on charges related to a fatal crash that occurred on Aug. 20, 2015. Kane was the driver of a vehicle that crashed along Route 903 in Penn Forest Township. Jasmine Fonseca, 15, and Taylor Shepherdson, 16, both of the Towamensing Trails development in Albrightsville, were killed in the crash. The two victims were students at Jim Thorpe High School.
Kane pleaded guilty to charges related to the crash and was sentenced in May 2018 by Serfass to serve three to one day less 24 months in the county prison followed by one year of probation.
Serfass also ordered Kane to make restitution of $35 to the victim, have no contact with the victim, pay court costs of about $1,000, pay a $50 per month supervision fee while on parole and render 100 hours of community service.
