Jim Thorpe man given prison term for domestic assault
A Jim Thorpe man was sentenced to a county prison term last week in the Carbon County court on charges stemming from a domestic incident.
David Ogilvie, 48, was sentenced by President Judge Roger N. Nanovic II to serve six to 18 months on a charge of simple assault. The prison time will be followed by six months of probation. On a harassment charge he was fined $300 and costs.
Ogilvie was arrested by Jim Thorpe police for an incident on Sept. 23, 2017, at his residence. Police responded to a reported domestic assault. On scene officers were told by a woman, who was in a relationship with Ogilvie at the time and living with him, that he had assaulted her.
Ogilvie took the case to a bench trial in February and was found guilty by Nanovic of simple assault and harassment and not guilty of a second count of harassment.
Ogilvie told Nanovic, “I’m sorry this case is before you. This got way out of proportion.”
Court records indicated that Ogilvie and the victim had a relationship and were living together in Northampton County when she obtained a protection from abuse order. She later asked the court to drop the PFA because she and Ogilvie had renewed their relationship.
The victim told Nanovic that there was heavy drinking of alcohol the day of the incident. She told the court she fears for her life and said Ogilvie had choked her and threatened her.
Nanovic also ordered Ogilvie to get both drug and alcohol and mental health evaluations, make restitution to the victim for $200, zero tolerance for drug or alcohol use, have no contact with the victim, pay court costs of about $1,000 and pay a $50 per month supervision fee while on parole and probation.
Ogilvie, who has been in prison on the charges, was given credit for 188 days already served.
