Man accused in teen sex case gets ARD

Brad Daniel Murphy, 37, Tamaqua, one of the four men accused of sex crimes with a 13-year-old Tamaqua boy in 2018, was admitted into the accelerated rehabilitative disposition program, in a decision by Schuylkill County Judge Cyrus Palmer Dolbin on Friday.

Murphy was slated to go to trial on multiple charges Monday. He’d been arrested by Tamaqua Police on Sept. 1, 2018, on charges of statutory sexual assault/11 years or older, involuntary deviate sexual intercourse person less than 16 years age, indecent assault of a person less than 16 years age, indecent exposure and corruption of minors. Murphy was admitted into the ARD program on the corruption of minors charge.

Admission into the ARD program does not mean that the person pleaded guilty. If he successfully completes the program, his record may be expunged. Murphy must pay $350 to the county to defray the cost of the ARD program, $50 in costs, and a $50 a month supervision fee while he is on probation for 12 months.

Murphy was one of four men accused of sex crimes involving the Tamaqua boy. According to the police investigation, the defendants contacted the victim through a cellphone dating app called Grindr.

In October 2019, two of the men entered guilty pleas. Former area music educator Dale Schimpf, 71, Frackville, entered guilty pleas to statutory sexual assault, corruption of minors and indecent exposure, and was sentenced to three to six years in state prison. Matthew Delgado, 29, Tamaqua, entered a guilty plea to corruption of minors — sexual acts, and was sentenced to nine to 23 months in Schuylkill County Prison.

In July 2019, Charles Raymond Joy, 59, Port Carbon, entered a guilty plea to indecent exposure and indecent assault charges and was sentenced to three to 23 months in county prison. All three must submit DNA samples and will have Megan’s Law registration requirements.

Murphy’s attorney Christine Holman last week filed a motion seeking to prevent the state from using certain evidence at trial. In the motion, Holman contended that there was no evidence that it was Murphy who was using the Grindr account. She also objected to the use of a single photograph — Murphy in a prison uniform — for identification purposes for the victim.

There was a time we immediately rejected child rape but now we have a president who engaged in it himself.
We had teacher issues in Lehighton with corruption of minors. Research what the board graciously did for the teacher that confessed to charges in Lehighton. Sickens me.

What are the odds that these people were caught on their first offense?

In my opinion, the educational employment contracts should provide a penalty to every teacher or staff member that failed to see the signs, and take action. Small, but enough to ensure they monitor their own, like hiring 200 free safety inspectors. Too often we learn fear of retaliation is greater that the moral responsibility to stop misconduct.

School teachers are ALREADY mandated reporters and subject to criminal charges if they don’t report suspected child abuse.

Mandated reporters are mandated to report, yet, why do we have so many problems, and so few reports?

Bullying, abuse, corruption of minors. The LASD district needs to protect the students, what do you think?

Should the district Protect the students or circle the wagons? When I see people defending the rubber stampers I feel like throwing up, I ask myself. How can a director, elected to oversee the administration for the protection of students rubber stamp actions that obviously were less than actions of fidelity of even common sense? What do you think?

And, how can a community allow it to go on for so long, when Larry, Wayne, Steve, Rita and Nathen have a majority? This should be fixed within seconds, right?

Who teachers these offenders to be so good are hiding things from all their coworkers, and friends?

Does the union meetings discuss opportunities to report mandated events needing reporting? We had so many angry parents attend the meeting. Where did they all come from?

You clearly didn’t know or you would not have made the statement. Teachers are required by law and by licensure to report abuse. Teachers contracts stipulate that they must follow laws and keep their license in good standing. The union contract with the school no doubt covers this under its disciple provisions. Again, how do YOU not know this?
The money spent was fighting lawful transparency, and that is immoral.
The latest county court decision found the district BROKE THE LAW, twice. What is your complaint to the immoral five?

My requests for transparency were free to provide, the only money wasted was the fights blocking them.

Larry Stern's two immunity pleas for instance were a total waste. He pled immunity, when I feel he should have just apologized for free.

The suits were all dropped only AFTER they ADDED a vote for the use of unlimited educational funds to fund a SLAPP matter. They proved to me they were immoral, what do you think? Taking the high road is easy, yet they struggle.

I have no complaint with the district withholding information that is private and confidential regarding my children and all the children in the district that you believe you are entitled to. The latest ruling was our court system working the way it should. It even noted the districted acted properly with the appeal and allowing due process for the court to decide. What is your intentions with the information? More ammo for you to make slanderous comments about district employees, board members, parents or even the children? It’s disgraceful how you speak of others here in the comments. As a child I was told to treat others the way I want to be treated and if you play nice with others they will play with you again. You talk about others being immoral; Do you believe how you speak of others in your comments to be of high moral status? As an elected official, I believe, it is unethical and certainly unprofessional. You may not like them, they may not like you, but airing your grievances here is not the place. Act like and adult and not a child having a social media spat with a peer. Oh one last thing regarding the bullying that is said to be occurring. I am not doubting bullying is occurring, but if you are going to take a stand and lead the fight against bullying in the district since you seem to mention it frequently now, I suggest you refrain from making further comments on articles and be a role model. Your attacks of name calling could be considered bullying behavior. You may not be causing physical harm, but harm can be caused to others just by words.
