Man passed out in car charged with DUI

James D. Felipa, 24, of Stroudsburg, is facing charges of driving under the influence of alcohol after he was found in an unconscious state in a gray Chevrolet Cruze at 7:51 p.m. March 26 at the Wawa Store on Route 209 in Chestnuthill Township.

State police at the Fern Ridge barracks said they were called there after Felipa was discovered to be unconscious. Police said they found him to be extremely intoxicated. He refused to get out of the car and was forced out of it and placed under arrest.

His car was towed from the scene.

How can he be charged with DUI while not driving? Is it a crime to sleep in your car, even while intoxicated? Seems to me he did the right thing by trying to sleep it off rather than drive.
