Man who drove under influence of drugs with son in car gets jail

Published March 21. 2019 12:48PM

A Carbon County man who drove a vehicle while under the influence of controlled substances was sentenced to a county prison term on Tuesday.

He previously pleaded guilty to driving under the influence charges and was sentenced by President Judge Roger N. Nanovic II.

Randall D. Perry II, 28, of Jim Thorpe, had his request for placement in the county’s Intermediate Punishment Program, house arrest, rejected by the court and must serve 30 days to 60 months in jail on a DUI count and the same term on a charge of endangering the welfare of children. The terms run concurrently.

Perry was arrested on Nov. 5, 2018, along School Street by Jim Thorpe police. A test revealed the presence of a controlled substance. In the vehicle was Perry’s then 7-year-old son.

Nanovic noted from the police report that Perry admitted using marijuana to the arresting officer, but a blood test revealed he had various types of illegal substances in his system at the time. Nanovic also noted that the test result showed that some of the drugs in his system were “far in excess of limits.”

Nanovic said the fact that he was driving with so many illegal drugs in his system with his young son in the vehicle was enough for the court to reject his IPP request.

Perry was also ordered to pay a fine of $2,500, his license was suspended for 18 months, he must render 100 hours of community service and zero tolerance imposed on drug or alcohol use.

Perry will begin serving the prison term at 5:30 p.m. on March 29 and serve it on consecutive two-day weekends.
