Maria L. Campomizzi filed an action in divorce against Steven T. Campomizzi, both of 83 Ryan Avenue, Tamaqua. They were married April 18, 1998.
Mortgage default
HSBC Bank USA, N.A., West Palm Beach, Fla., filed a suit against David and Kimberly Barninger alleging they have defaulted on mortgage payments on a property at 21 Wertman's Hollow Road, Andreas, West Penn Township, and seek foreclosure. The principal balance allegedly owed is $344,868.67 plus interest and costs.
Bank of America, Simi Valley, Calif., filed suit against Brenda Orach, 460 Timber Circle, Wayne Township, as executrix of the estate of Christopher M. Moser, late of Tamaqua, alleging mortgage payments on a property at 248 Van Gelder St., Tamaqua, are in default and seek a foreclosure. The principal alleged owed on the property is $35,799.09 plus interest and costs.
Credit card suits
CACH, LLC, Denver, Colo., filed suit against John Blasko, 28 Kettle Road, Tamaqua, alleging an unpaid balance of $4,911.81 is owed on his credit card plus interest and costs.
Portfolio Recovery Association, LLC, Philadelphia, filed suit against Susan Goho, 69 First St., Coaldale, alleging a balance of $2,938.21 is owed on her credit card plus interest and costs.
Asset Acceptance, LLC, filed suit against Cynthia A. Davis, 17 Delano Road, Rush Township, alleging she owes a balance of $12,030.26 on her credit card plus interest and costs.
Mixed verdict
A jury could not agree on a verdict in the trail of Kyle Kent, 32, Mount Carmel, on charges of aggravated assault, kidnapping, criminal trespass, stalking, unlawful restrain, simple assault and recklessly endangering Melissa Kent, 334 E. Mahanoy Avenue, Girardville.
Judge Jacqueline Russell declared it a mistrial and his case went back to the trial list. His current bail was continued. However, the jury did find him guilty of criminal mischief and harassment and Russell fined him $300 each and court costs and make restitution of $259.58 to the victim.
Changes plea
Nicole Lynn Kressler, 28, Mahanoy City, was scheduled to go on trial on a charge of retail theft but when Judge John E. Domalakes entered the court room she announced she had changed her mind and entered a guilty plea. The jury was dismissed and Kressler was sentenced to serve 23 months on probation, pay $50 to the Criminal Justice Enhancement Account fund, a $50 monthly supervision fee, and make restitution of $22.85 to Redner's Warehouse Market in Shenandoah.
Resigns as officer
Mary Ann Pautienus resigned as Judge of Election of the Election Board of the South Ward, Frackville precinct because she is moving to another county.
George T. Albert resigned as Minority Inspector of the Election Board of First Precinct, North Manheim Township, as he is relocating to Florida.
Warrant hearings
Ryan Gallo, 38 Glenden Road, Mahanoy Township, formerly of 705 Claremont Avenue, Tamaqua, had his bench warrant dissolved by Judge James P. Goodman and he was remanded to the county prison to serve his sentence.
He was sentenced in November 2007 to serve 31 days in the county prison on a charge of possession of a small amount of marijuana and when his probation was revoked he was sentenced in January 2009 to serve three to 12 months in the county prison effective January 19, 2009. However, he failed to show up at the county prison on that day so a bench warrant was issued.
Jeffrey Lee McCurdy, 43, Lebanon, had his bench warrant dissolved by Goodman and it was reset at $5,000 unsecured, which means he does not post any money, however, if he jumps bail he is liable for the amount fixed by court.
He must reside at 2 Peach Street, Pine Grove, and cannot relocate without court permission. A warrant was issued for his arrest because he failed to appear at the county court for a preliminary conference. He faces a charge of theft by deception by issuing a check in amount of $553.28 to Pine Grove Yamaha Pine Grove Shop for parts and repairs to a motorcycle.
Matthew Thomas Riddick, 58, Shenandoah, had his bench warrant dissolved by Judge Charles M. Miller and he was remanded to the county prison to serve his sentence.
He had pleaded guilty to a charge of possession of a controlled substance and was sentenced to serve six to 23 months in the county prison and the sentence was to begin Feb. 10, however, he failed to show up on that day at the prison and a bench warrant was issued.
