The suit states on Oct. 6 and 7, the defendant Riverwalck, through an employee, served Miller alcohol while he was visibly intoxicated, which is a violation of state law and the defendants' liquor license issued by the state. Miller lost control of the vehicle while negotiating a curve with the Malibu leaving the road and striking a tree on the passenger side, then continued on and struck a second tree with the front end, where it came to rest. Miller then fled the scene leaving Karlick, who the suit states was seriously injured, without getting any help. Miller was later located by police, the suit notes.
