Liquor violations in Schuylkill

The Allentown enforcement office of the state liquor control board has cited several Schuylkill County businesss for violations of the state liquor code, including three in the Tamaqua area.

Freddy's Pub, LLC, trading as Freddy's Pub, 14-16 Mauch Chunk St., Tamaqua, was cited for used, or permitted to be used on the inside of licensed premises a loudspeaker or similar device whereby the sound of music or other entertainment or the advertisement thereof, could be heard outside. The alleged violation occurred on May 27, June 24 and 25.

The West Penn Game Fish & Forest Protective Association, 1047 Clamtown Rd., West Penn Township, was cited for local option small games of chance act violation, by failing to maintain complete and truthful records covering the operation of the licensed business for a period of two years immediately preceeding June 15.

Carnes Enterprises, LLC, trading as Clamtown Tavern, 1000 Clamtown Rd., West Penn Township, was cited for failed to require patrons to vacate that part of the premises habitually used for the service of alcoholic beverages not later than one-half hour after the required time for the cessation of the service of alcoholic beverages.

Carnes was also cited under the crimes code section of the liquor code for possessed or operated gambling devices or paraphernalia or permitted gambling or lotteries, poolseeling and/or bookmaking on licensed premises. The allege violations occurred on various dates.

Other Schuylkill County businesses cited were:

Tommy's M&S, 58 N. Second St., Saint Clair, for sold alcoholic beverages after restaurant liquor license expired on March 21, and had not been renewed and/or validated. The alleged offense occurred on May 20.

Corky's Foutth Street Station Inc., 345 E. Colliery Ave., Tower City, was cited for licensed establishment was operated in a noisy and/or disorderly manner. The alleged offense occurred on various dates.

LaCasita De Familia LLC, 8 E. Centre St., Shenandoah, was cited for used, or permitted to be used on the inside of licensed premises, a loudspeaker or similar device whereby the sound of music or other entertainment, or the advertisment thereof, could be heard outside. The alleged offense occurred on July 2.

Robert Welikonich, trading as the Hard Hat Cafe, 113-115 Centre St., Shenandoah, was cited for seven violations as follows: licensed was not a bona fide restaurant in that you, by your servants, agents or employees, maintained insufficient food items, eating utensils, dishes, seating, and/or failed to provide food upon request, violations occurred Dec. 1, 2010 and Jan. 11; consumed alcoholic beverages while tending bar or otherwise serving alcoholic beverages, on Dec. 1 and 28, 2010; Clean Indoor Act violation - smoked and/or permitted smoking in a public place where smoking was prohibited - offenses on Dec. 28, 2010, Jan 11 and 20; operated licensed establishment without a valid health permit or license, which expired on Dec. 26, 2008 - violations on Oct. 26, Dec. 1 and 28, 2010, and Jan. 11 and 12; failed to keep records on the licensed premises, violation Jan. 11; Clean Indoor Act, failed to post signage as required by the act - violations on Jan. 11 and 12; and failed to appoint a board-approved full-time manager for the licensed premises - violations from Dec. 20, 2008, through Jan. 20.

The various violations filed against the establishments listed will be brought before an administrative law judge who has the authority to impose penalties ranging from $50 to $1,000 for minor offenses and up to $5,000 for more serious offenses. In addition, the judge can also impose a license suspension or revocation of the license based on the severity of the charge.
