Assumpsit complaint

Oliphant Financial, LLC, Sarasota, Fla., has filed a complaint in assumpsit against Terry Petitto, 119 Eliot lane, P.O. Box 248, Albrightsville, seeking the sum of $1,141.98 plus applicable costs, interest and attorney's fees.

The plaintiff contends it is a debt buyer that holds a promissory note signed by the defendant in which the latter agreed to pay costs associated with valuable considerations it received. Oliphant says the defendant has not made a payment on the account since Dec. 18, 2009.

Credit defaults

The following actions have been filed by credit card companies, or their collection agencies, for alleged defaults on credit card/loan accounts:

Citibank South Dakota, N.A., SiouxFalls, S.D., filed against Barbara A. Howell, 1249 German's Road, Lehighton, seeking $16,395.23, plus costs.

Advantage Assets II, Inc., Houston, Tex., filed against Timothy A. Pettit, 51 Wargo Road, Jim Thorpe, seeking $2,724.81, plus costs.

FIA Card Services, N.A., Newark, Del., filed against Keith A. Burkit, 13 Blue Mountain View, Kunkletown, seeking $5,132.85, plus costs.

FIA Card Services, N.A., Newark, Del., filed against Steven M. Zaitz, 15 Iowa Road, Albrightsville, seeking $5,999.62, plus costs.

Advantage Assets II, Inc., Houston, Tex., filed against Rodolfo Lopez, 218 Goldberg Lane, Lehighton, seeking $2,442.44, plus costs.

Judgment recorded

The University of Pennsylvania, New Bolton Center, Kennett Square, Pa., has transfered to Carbon County Court a judgment entered in its behalf in Philadelphia.

The defendant is Patsy Jones, 152 Franklin Road, Lehighton.

The document lists a judgment in the amount of $3,1545.25, plus costs of $111.30, for a total of $3,266.55.

Mortgage foreclosures

The following actions have been filed as mortgage foreclosures for alleged defaults on loans:

BAC Home Loans Servicing, L.P., f/k/a Countrywide Home Loans Servicing, Simi Valley, Calif., filed against John D. Keely, 73 Brittany Drive, Albrightsville, over a property at that address. Sought is $81,875.31 and continuing interest and costs.

Wells Fargo Bank, N.A., Fort Mill, S.C., filed against Theodore M. Andrews, 121 Main St., Coxeville, over a property at that address. Sought is $89,698.29 and continuing interest and costs.

Divorce complaint

Marlene Schrantz, 380 Center Road, Lehighton, filed against Travis Schrantz, 45 Church St., Lehighton. They were married on June 30, 2007.

Breach of contract

VNB Loan Services, Inc., Chestnut Ridge, N.Y., has filed a complaint against Kenneth Portz, 412 W. Iron St., Summit Hill, regarding a contract over the purchase of a motor vehicle.

The complaint alleges the defendant received a motor vehicle he purchased at Lehighton Lincoln Mercury, which assigned its rights, interest and title to the plaintiff. VNB Services claims the defendant is in default of the contract, having failed to make timely monthly payments. The plaintiff is seeking the balance due of $10,183.24, interest of $1,587.12 and attorney's costs of $2,240.31 for a total judgment of $14,010.67.
