Tamaqua area man sentenced on drug counts

Five area residents were among 18 who entered guilty pleas recently in Schuylkill County court and were sentenced by Judge Jacqueline Russell as follows:

Joseph Michael Lincovich, 53, of 602, Wyoming Street, Tuscarora, Schuylkill Township, on a charge of delivery of a controlled substance in Pottsville was sentenced to serve 18 to 36 months in a state correctional facility with credit for serving 122 days in the county prison, pay $50 to Criminal Justice Enhancement Account (CJEA) fund, $113 to Bethlehem Regional Lab, $50 to Schuylkill County Drug Task Force, $100 to Substance Abuse Education (SAE) fund. He was arrested by Cpl. Dennis Wiederhold, Pottsville police.

Robert R. Bachert, 60, of 113 Bull Run St., Coaldale, on a charge of driving under the influence (DUI) was sentenced to serve 72 hours to six months in the county prison and granted parole on completion of his minimim sentence. He was also ordered to pay a fine of $1,000, cost of prosecution, $300 to SAE fund, $50 to CJEA fund, perform 20 hours community service and make restitution of $60 to Schuylkill Medical Center. He also must enroll and successfull complete the alcohol highway safety school and outpatient counseling and his driver's license is suspended 12 months. Bachert was cited by Patrolman Charles Blesse, Coaldale police.

Andrew John Bobey, 45, of 14 N. Hancock St., McAdoo, on a charge of possession of a controlled substance was placed on probation 12 months, pay $100 to SAE fund, $50 to CJEA fund, perform 20 hours of community service, make restitution of $290 to Bethlehem Regional Lab, and pay a $25 fine plus costs on a charge of defiant trespass on Kline Township Municipal Authourity property in Kelayres.

Joseph Robert Schaeffer, 30, of 1921 Hillside Lane, New Ringgold, on a charge of being involved in an accident with another vehicle in Cressona last August was placed on probation 12 months, fined $100, pay court costs, pay $50 to CJEA fund, and perform 20 hours community service. On a charge of striking a parked car and failing to stop was fined $300; failing to yield the right of way was fined $25 and careless driving fined $25 plsu $150 in costs. On a charge of giving a false report to Orwigsburg police was given a concurrent 12 months probation, fined $100 and costs and pay $50 to CJEA fund.

Jason Hill, 19, of 217 Mush Dale Road, New Ringgold, on a charge of corruption of a minor was placed on probation 23 months and on two counts of possession of a controlled substance received a concurrent 12 months probation, pay $200 to SAE fund, and perform 40 hours community service. Hill was cited by Sgt. Richard Weaver, Tamaqua police.

Harold Caddy, 33, Shenandoah, on a charge of possession with intent to deliver a controlled substance, was sentenced to serve three to 23 months in the county prison with credit for serving 28 days, fined $100, pay $100 to SAE fund and $50 to CJEA fund. Caddy was cited by the Schuylkill County Drug Task Force.

Sammy Jo Rohrback, 23, Pottsville, on a charge of theft of a purse was given credit for seving 16 days in the county prison and released on probation for 12 months, pay $50 to CJEA fund, and perform 20 hours of community service. He was cited by Patrolman Brian Kotzmoyer, Pottsville police.

Ebony Marie Williams, 20 , Pottsville, on charges of criminal conspiracy and delivery of a controlled substance was given credit for serving 26 days in the county prison and was released on probation for 23 months, pay $50 to CJEA fund, $100 to SAE fund, $226 to Bethlehem Regional Lab, $110 to Pottsville Police Drug Task Force, and perform 20 hours community service. Williams was cited by Capt. Richard Wojciechowsky, Pottsville police.

Barbara A. Komosinsky, 50, Shenandoah, on a charge of delivery of a controlled substance was sentenced to serve six to 23 months in the county prison with credit for serving 28 days, fined $100 and assessed court costs, pay $100 to SAE fund, $50 to CJEA fund, perform 20 hours community service and make restitution of $113 to Bethlehem Regional Lab and $50 to Schuylkill County Drug Task Force.

Valerie Lee Gudinas, 27, Pottsville, on a charge of possession of a controlled substance and drug paraphernalia was placed on probation 12 months, pay $100 to SAE fund, $50 to CJEA fund, $113 to Bethlehem Regional Lab, and perform 40 hours community service. Gudinas was cited by Patrolman Bryan Pyle, Branch/Reilly Townships police.

James Clifford Morgan, 25, Williamstown, on a charge of criminal conspiracy was sentenced to serve three to 23 months in the county prison with credit for serving 35 days in the county jail, pay $50 ot CJEA fund, and perform 20 hours community service. Charges of theft of a purse and receiving stolen property were nol prossed, however, Morgan was ordered to stay away from Jennifer Aungst whose purse he stole in the Brown Jub Bar in Porter Township. He was cited by Trooper John Carr.

Jared John Holt, 21, Schuylkill Haven, on a charge of assaulting Crystal Hornberger at 404 Saint John Street, Schuylkill Haven, was given credit for serving 28 days in the county prison and released on probation 12 months, pay $50 to CJEA fund, and perform 20 hours of community service. Holt was cited by Patrolman David George, Schuylkill Haven police.

Steven Douglas Grugan, 46, Hamburg, on a charge of driving while operating privileges were suspended-DUI related, was sentenced to serve 90 days in the county prison, pay a fine of $500, and pay $50 to CJEA fund. On a charge of careless driving was fined $25 plus $50 costs. Grugan was cited by Patrolman David George, Schuylkill Haven police.

Michael Joseph Shefcyk, 32, Cressona, on a charge of driving while operating privileges were suspended was sentenced ot serve 30 days in the county prison, however, because of an illness will be allowed to serve the sentence under house arrest with electronic monitoring beginning March 1, pay a $1,000 fine, pay $50 to CJEA fund, and $60 to Schuylkill Medical Center. Shefcyk was cited by Patrolman George.

Diane F. Bechtel, 48, Auburn, on a charge of engaging in a deceptive business practice was sentenced to serve nine to 23 months in the county prison, pay $50 to CJEA fund, and make restitution of $63,500 to Russell and Florence Peiffer and $2,500 to Harold and Nancy Kraus. She was also ordered to perform 40 hours of community service. On a charge of theft by deception to serve an additional five years on probation and perform 20 hours of community service.

The sentence to begin Monday, March 1, and she is to report to the county prison at 9 a.m. Bechtel was cited by Trooper Timothy Reinhoel who filed a report showing from 1994 to the present she forged statements of two business accounts.

Amanda Lynn Dewald, 34, Orwigsburg, on a charge of unlawful taking of personal property was given credit for serving 45 days in healthcare center and released on probation 23 months, pay $50 to CJEA fund, perform 40 hours of commmunity service and have no contact with the victim, Martha Daley. Charges of theft by deception and unlawful use of a computer were nol prossed. Dewald was cited by Criminal Investigator Vincent McDonald, Schuylkill Haven police.

Nicole Marie Elsdon, 27, Schuylkill Haven, on a charge of assaulting Kim Berger, of 31 Fritz Reed Avenue, Schuylkill Haven, was placed on probation 12 months, pay $50 to CJEA fund, and perform 20 hours community service. On a charge of recklessly endangering another person received a concurrent 12 months probation sentence.

Lamar Garner, 21, Philadelphia, on a charge of possession of a controlled substance was sentenced to serve three to 12 months in the county prison with credit for serving 11 days, pay $50 to CJEA fund, $100 to SAE fund, makle restitution of $113 to Bethlehem Regional Lab, and perform 20 hours of community service. Garner must also forfeit his vehicle. He was cited by Patrolman David George, Schuylkill Haven police.

Alicia Marie Roten, 28, Williamstown, on charge of possession and delivery of controlled substance as cited by the Schuylkill County Drug Task Force, was sentencedf to serve 18 to 48 months in a state correctional facility, pay $200 to SAE fund, $100 to CJEA fund and make restitution of $541 to Bethlehem Regional Lab and $220 to county drug task force.

Each defendant must also pay court costs and a $50 per month supervision fee while on probation or parole.
