Pleads guilty
Ramon Garcia Jr., 32, Pottsville, pleaded guilty to four counts of possession of a controlled substance and was sentenced by Judge William E. Baldwin to serve three to 18 months in the county prison and received credit for having served 16 days in prison. He also must pay $50 to Criminal Justice Enhancement Account, a $50 monthly supervision fee and pay all costs of prosecution.
He was cited by Patrolman Mark O'Toole, Pottsville police. He previously had been admitted to the Accelerated Rehabilative Disposition (ARD) probation program but he was removed from it for violating terms fixed by the judge and then entered a guilty plea last December. His sentence was postponed until now.
Garcia also pleaded guilty to a charge of driving under the influence of alcohol (DUI) and was sentenced by Baldwin to serve five days to six months in the county prison but the sentence runs concurrent with the drug charge sentence. He has to pay a fine of $300, pay $100 to Substance Abuse Education fund, $50 to Criminal Justice Enhancement Account, $50 to Catastrophe fund, a $50 monthly supervision fee and court costs. On a charge of being involved in an accident and damaging a vehicle was fined $300 and serve 30 to 60 days in prison but it also runs concurrent to the drug charge and on a charge failing to stop for a red light was fined $25 plus $100 in costs. Garcia was cited by Patroman John Englert, Pottsville police.
Lift bench warrant
Brian R. Kehl, 27, of 117 Catawissa Street, Tuscarora, Schuylkill Township, after a hearing before Judge Miller had the bench warrant issued to bring him to court lifted and bail was set at $5,000 percentage cash and he was ordered to abide by the following rules:
He must reside with Alicia Whah, 114 Patterson St., Tamaqua, but before he can be released on bail Whah must complete an address affidavit in the district attorney's office and he may not relocate without permission from the district attorney; he shall not possess or consume alcoholic beverages or controlled substances; shall not travel outside the state without written permission from the district attorney; shall submit to random urinalysis or other drug tests at request of his probation officer; shall secure and maintain gainful employment within 30 days and if unable to to notify his probation officer.
Kehl was cited by Patrolman Charles Blesse, Coaldale police, with driving under the influence of alcohol last June.
Bail Hearing
Anthony James Cress, 23, Pottsville, was granted a modification of his bail by Judge Charles M. Miller to $5,000 unsecured but he has to abide by a number of conditions. They are: he must have an address affidavit completed and reside with either his father or step-father and may not relocate without written permission from the district attorney's office; he shall not possess or consume alcoholic beverages, controlled substances or possess drug paraphernalia; he shall submitted to random urinalysis or other drug testing at request of his probation officer and he shall secure and maintain gainful employment within 30 days and if not secured to immediately notify his probation officer. Cress was cited by Pottsville police for loitering and prowling.
Divorces granted
Edward Bumbulsky, 65 W. Church St., Hazleton, was granted a divorce from Tina Marie Bumbulsky, 626 E. South St., Mahanoy City. They were married Aug. 20, 1994.
George A. Lengle was granted a divorce from Jane I. Lengle, both of Pine Grove. They were married June 16, 1975.
Daniel J. Chinchar, 718 Hilltop Drive, MaryD, Schuylkill Township, was granted a divorce from Lori L. Chinchar, 119 Mountain Road, Tamaqua. They were married June 6, 1997.
Dawn S. Comisac was granted a divorce from Michael S. Comisac, both of 41 Rocky Lane, New Ringgold. They were married Feb. 24, 2006.
Rhonda Demchak was granted a divorce from Thomass Demchak, both of Pine Grove. They were married Dec. 12, 1992.
Lift bench warrant
Kevin Endriga Fort, 22, Coaldale, who was brought into court on a bench warrant after he failed to appear for court hearing, had the bench warrant lifted by Judge Charles M. Miller and bail was set at $5,000 percentage and special conditions were set.
Fort must reside at 113 W. Miner St., Coaldale, and may not relocate without written permission from the district attorney's office, he shall not consume alcoholic beverages, controlled substances or possess drug paraphernalia, he shall not travel outside the state without permission from the district attorney, he shall submit to random urinalysis or other drug tests at requested by his probation officer, he shall secure and maintain gainful full time employment within 30 days and if not secured to immediately notify his probation officer and he shall follow the standard bail requirements for court appearance.
Fort was charged by Patrolman William Longworth, Coaldale police, with driving under the influence of alcohol (DUI).
Election officers
President Judge William E. Baldwin filled a vacancy on a West Mahanoy Township Election Board in preparation for the May 18 Primary Election. In the First District, Marie Lally was named judge of election, Ann Joyce, majority inspector, and Roseanne Miller, minority inspector.
