Joseph Robert Shaffer, 30, of 192 Hillside Lane, New Ringgold, was removed by Judge Charles M. Miller from the Accelerated Rehabilative Disposition (ARD) probation program. It is a special probation program for first offenders to permit them to clear their name by completing the conditions imposed by a judge.
Shaffer was admitted to the program on June 18, 2008, for a to serve a 12 month period. The probation department now asked the court to remove him from the program because he violated the rules. He now faces trial on a charge of driving under the influence (DUI) of alcohol and if convicted the record stands forever.
Joseph Chimahosky, Ashland, was removed by Judge John E. Domalakes from the Intermediate Punishment Program (IPP) for violating conditions fixed by the court. He was re-sentenced to serve 30 days to six months on house arrest with credit for serving 25 days. He also must successfully complete outpatient counseling and pay all fines and costs previously imposed. Chimahosky entered a guilty plea to charges of DUI on Sept. 8, 2008, and was placed in the IPP for six months.
Justin L. Tielman, 26, Pottsville, had his probation revoked by Domalakes for violating terms fixed by the court and he was re-sentenced to undergo a period of incarceration of not less than time served (36 days) to 23 months in the county prison and when released shall have no contact with minors. Tileman had pleaded guilty to retail theft on Aug. 22, 2007, and began a 12 months probation sentence when his state sentence expired.
Rochelle Shaleen Hauze, 23, Ashland, had her probation revoked by Domalakes for violating rules and was re-sentenced to serve one to two years in a state correctional facility. Hauze had pleaded guilty to a charge of theft on Nov. 20, 2007, and was placed on probation for 18 months, however, she had her probation revoked on two separate occasions and was finally placed on probation for five years which she has now violated.
