Three sentenced on drunk driving charges

Three persons were sentenced to county prison terms Monday in Carbon County court after previously pleading guilty to driving under the influence (DUI) charges.

The three sentenced were:

Randy L. Dieter, 37, of Ashfield, was sentenced to serve a total of 90 days to six months in prison on a DUI count and a charge of driving while under suspension-DUI related. He was arrested on May 16 along Blue Mountain Road in East Penn Township while operating a all terrain vehicle (ATV). Given a test, the result was .13BAC.

President Judge Roger N. Nanovic sentenced Dieter to serve 30 days to six months on the DUI count, a fine of $1,000 and court costs and one year license suspension. On the driving under suspension he was sentenced to serve 90 days in jail, a fine of $1,000 and will receive another one year suspension. The jail terms run concurrently.

He will begin the jail term at 6 p.m. on Friday, Dec. 4, and was granted work release privileges.

Robert Richards, 55, of Lehighton, was sentenced to serve 90 days to six months in prison on a DUI count, his second conviction. He was arrested on Dec. 21, 2007, in Mahoning Township. He was also sentenced on a charge of recklessly endangering count. Nanovic placed him on probation for a year on that charge with it running consecutive to the DUI charge.

Richards was also ordered to pay a fine of $500 and costs and his license was suspended for a year.

He begins the jail term on Friday, Dec. 4, at 7 p.m., and was granted work release privileges.

Mark W. Gallagher, 45, of White Haven, was sentenced to serve 72 hours to six months in prison by Senior Judge Richard W. Webb. Gallagher was arrested on Nov. 21, 2007, along SR940 in Kidder Township. He refused a blood test and will lose his license for a year.

Webb also imposed a fine of $1,000 and court costs, and another one year suspension.

He will begin the jail term on Dec. 7 at 9 a.m.

Each defendant must also get a drug and alcohol evaluation and follow any recommendation for treatment. Each must pay a $50 per month supervison fee.
