19 enter guilty pleas in Schuylkill
Judge D. Michael Stine took on the role of Kriss Kringle and not Ebenezer Scrooge in accepting guilty pleas of 19 defendants in the Schuylkill County Court Tuesday as he did not sentence anyone to spend Christmas Day in prison. Four men did get prison sentences but one begins after Christmas, another not until March of next year and two others had the sentences run concurrent with sentences now serving.
Justin Michael Wilson, 27, of Ashland, on a charge of aggravated assault on his very young son causing the child to suffer from a beating fractured ribs and multiple bruises, was sentenced to serve three years to six years in a state correctional institution. He is to report to the county sheriff on January 4 at 9 a.m. to be transported to the prison. After he is released from prison he must serve 10 years on probation, also, in order to have visitation rights he must make arrangement through the Schuylkill County Children and Youth Services Agency and be supervised. Wilson was also ordered to pay $50 to the CJEA (Criminal Justice Enhancement Account) fund, costs of prosecution, a $50 monthly fee for each month he will be on probation and make restitution of $3,925.
Luis Alberto Texis-Texis, 24, of Wilkes-Barre, on a DUI (driving under the influence) charge was sentenced to serve 72 hours to six months in the Schuylkill County Prison but he doesn't report to prison until December 28 at 9 a.m. to start his sentence. When released on probation he must pay a fine of $1,000 and court costs, pay $300 to the SAE (Substance Abuse Education) fund, a $50 monthly probation fee for each month he will be on probation, pay $50 to the CJEA fund and make restitution of $60 to the Schuylkill Medical Center and $50 to the district attorney's office.
Glen Stanley Moczulak, II, Pottsville, on a charge of possession of a controlled substance was sentenced to spend four months to 12 months in the county prison but the sentence is to run concurrent with a sentence he is now serving. On a charge of possession of drug paraphernalia he also received a concurrent sentence. He must pay fines totaling $200, plus court costs, $200 to the SAE (Substance Abuse Education) fund and $100 to the CJEA fund.
Denise D. Wisner, 38, Mahanoy City, on a DUI (driving under the influence) charge was placed in the Intermediate Punishment Program for six months with the first 30 days under home arrest under electronic monitoring and pay a $12 per day fee with the remainder of the sentence to be served on probation, pay a $50 monthly probation fee, a fine of $750 and court costs, make restitution of $60 to the Schuylkill Medical Center and attend the alcohol highway safe driving school. On a summary charge of not having a driver's license was fined $200 and costs.
Donte Tarron Brown, 20, Pottsville, on a charge of theft was given credit for serving 120 days in prison and released on probation for 23 months, pay a fine of $100 and on a charge of possession of a small amount of marijuana was placed on probation 30 days to run concurrent to the theft sentence, pay $100 to the SAE fund and $50 to the CJEA fund.
Stacey M. Cambria, 40, Frackville, on a charge of theft was placed on probation for 18 months and must attend the Retail Theft Diversion Program and make restitution of $506.33 to K-Mart Store, Schuylkill Mall. According to the police report Cambria while employed failed to scan a number of transactions.
Rachelle Lynn Cassidy, 28, Kulpmont, on a charge of retail theft was placed on probation for 12 months, pay a fine of $100 and court costs, $50 to the CJEA fund, a $50 monthly probation fee and make restitution of $120.75 to Walmart Store, Rush Township.
Michael John Liptok, Jr., 22, Pottsville, on charges of simple assault, recklessly endangering another person, interference with custody of children and selling or furnishing alcohol beverages to minors, was placed on probation for 36 months, pay a $50 monthly probation fee, pay $1,200 in fines, pay $150 to CJEA fund and cost of prosecution.
Kyle James Luscavage, 22, Pottsville, on a charge of public drunkenness was fined $100 plus $135.50 costs.
Kevin Matthew Mabry, 23, Buck Run Village, Foster Township, pleaded guilty to a number of charges, disorderly conduct, possession of a controlled substance, indecent assault and corruption of minors and Judge Stine deferred sentencing and ordered Mabry be evaluated by the state's sexual assessment board and scheduled sentencing for March 19, 2010.
Matthew Eli Miller, 18, Orwigsburg, was placed in the Intermediate Punishment Program for six months for the charge of driving under the influence of alcohol as a minor. He escaped spending a month in prison because he was a patient in a rehab center for 20 days and will be on probation for six months, pay a $50 monthly probation fee, pay a fine of $750 and court costs, pay $100 to SAE fund, make restitution of $60 to Schuylkill Medical Center, undergo intensive outpatient counseling followed up with a mental health evaluation. On a charge of failing to wear a seat belt was fined $10 plus costs.
Julio A. Pena-Silva, 42, Reading, on a charge of retail theft of a car engine from Naftzinger Used Auto Parts Company, was placed on probation 12 months, pay a $50 monthly probation fee and $50 to CJEA fund and on a charge of driving without a license was fined $200 plus costs.
Martin Louis Pinder, Jr., 25, Leesport, on a charge of possession of drug paraphernalia was placed on probation 12 months, pay a $50 monthly probation fee, $100 to SAE fund and costs of prosecution.
Randy Paul Reinert, 33, New Tripoli, had his sentence postponed after he pleaded guilty to charges of indecent assault, corruption of minors and selling or furnishing alcohol beverages to minors. Judge Stine ordered a pre-sentence investigative report prepared by the adult probation department and scheduled sentencing for March 19, 2010.
Gerald Patrick Roche, 46, Girardville, on charges of recklessly endangering another person, resisting arrest and involved in accident causing damage to private property, was placed on probation 23 months, pay a monthly $50 probation fee, a fine of $100 and court costs, pay $50 to CJEA fund and make restitution of $1,869.06 to Marie Groody for damage to her property and $4,603.01 to Travelers Insurance Company.
John Charles Russen, 20, Lost Creek, West Mahanoy Township, on a charge of simple assault was placed on probation 23 months, pay a fine of $100 and court costs, a $50 monthly probation fee, $150 to the district attorney's office and on a charge of harassment was fined $25 and costs.
Caaesar Mageone Saunders, 33, Shenandoah, on a DUI charge was sentenced to serve 48 hours to two years in the county prison but since he completed inpatient treatment was released immediately on parole, fined $500 and court costs, pay $100 to SAE fund, a $50 monthly probation fee and court costs and make restitution of $60 to Schuylkill Medical Center.
James Randy Teliha, 24, Wilkes-Barre, on charges of theft and criminal conspiracy was sentenced to serve three months to 12 months in the county prison but the sentence runs concurrent with a sentence he is now serving, pay $200 in fines and court costs, a $50 monthly probation fee and $50 to CJEA fund.
Justin R. Underkoffler, 21, Tower City, on a charge of possession of drug paraphernalia and a small amount of marijuana was placed on probation 12 months, fined $100 and court costs, pay a $50 monthly probation fee, pay $50 to CJEA fund and court costs.
